[02.02.2012]Supreme Court cancels all the 122 2G licenses granted by A. Raja – A major blow to the UPA govt.

In a major blow to the UPA government, the Supreme Court has ordered cancellation of all the 122 2G licenses issued by A. Raja, in January, 2008. The Supreme Court has observed that the licenses were granted in “arbitrary and unconstitutional” manner. The Court has asked the TRAI to recommend a new process of allocation of licenses, along with guidelines for auctioning the spectrum. The Supreme Court has left it to the trial court to decide, whether P. Chindambaram should be investigated by the CBI or not.

[31.01.2012]Conciliation meeting with CLC

Conciliation meeting, called on by the Chief Labour Commissioner, took place today. The JAC leader, including Com. P. Abhimanyu, GS, BSNLEU and Com. V.A.N. Namboodiri, Convener, JAC, participated in the meeting. However, shortly after the meeting started, the CLC had to leave, due to unavoidable circumstance. Hence, the meeting is postponed to 01-03-2012.

NFTE, in it’s website updating on 19-01-2012, has claimed that 194 new members have joined that union at Indore, in Madya Pradesh. Now, subscription deduction has taken place from the salary for the month of January, 2012. Subscription has been deducted from the salary of only 120 employees in favour of NFTE at Indore. At the same time subscription has been deducted from the salary of 574 employees in favour of BSNLEU. If 194 new members have joined NFTE in the month of January, then why subscription has been deducted only from 120 members?

1996 telecom scam: Sukhram gets 5 years in jail

Mr Sukhram, Former Telecom Minister

New Delhi, Nov 19:

Former Telecom Minister, Mr Sukhram, has been sentenced to five years in jail in the 1996 telecom scam case. Mr Sukhram will be taken into custody and sent to jail to serve punishment, court sources said. The court has ordered arrest of Mr Sukhram.

Mr Sukhram, convicted for taking Rs 3 lakh as bribe to give a lucrative contract to a private firm in 1996, today pleaded for leniency in a Delhi court on grounds of his old age while the CBI called him a “habitual offender” and sought maximum punishment for him.

86-year-old Sukhram has been held guilty for misusing his official position during his tenure as Telecom Minister in P.V. Narasimha Rao’s Cabinet in giving a contract worth Rs 30 crore to private firm Haryana Telecom Ltd (HTL) to supply 3.5 lakh conductor kilometers (LCKM) of Polythene Insulated Jelly Filled (PIJF) cables to the Telecom Department.

He was held guilty on Thursday under various provisions of the Prevention of Corruption Act and the Indian Penal Code.

Various offences under which he has been convicted entail a maximum sentence of 7 years jail term.

The court is likely to pronounce its ruling on quantum of sentence at 2.30 p.m.

Appearing for Mr Sukhram, his counsel pleaded to Special Judge Mr R.C. Pandey, “I(Sukhram) am an 86-year-old person and attending the trial for past 12 to 13 years. I suffer from old age-related ailments and have lost my wife. Therefore, a lenient view may be taken.”

He also submitted that “age is a good consideration for leniency“.

He said that “as such it is not a case where government has lost any money. The CBI allegation was that he (Sukhram) took bribe but no financial loss has been caused to the Government exchequer.”

Responding to this, the CBI prosecutor argued that Mr Sukhram is a “habitual offender” as he has been sentenced in two other cases also and deserves no leniency.

promotiion scheme,, the reservatiions are not possiiblle.. We propose that even though iit iis not a
post based promotiion scheme,, rellaxatiion iin qualliiffyiing serviice iin a partiicullar scalle ffor promotiion
to next scalle be giiven to the SC/ST offffiiciialls on the ffollllowiing grounds::
a)) Earlliier,, iin the OTBP/BCR promotiion scheme the SC/ST offffiiciialls were giiven rellaxatiion iin

reserved vacanciies off SCs,, STs and OBCs have to be ffiilllled up by 31--3--2012.. IIt iis requested to
iinfform the actiion taken and resullt achiieved so ffar and to take necessary actiion so that allll these
vacanciies are ffiilllled up by the target date 31--3--2012..

theiir ffiirst promotiion.. Examplle:: A TM got BCR on 18--10--2000 and was promoted as TTA on 28--2--
2009.. The offffiiciiall has to be giiven second promotiion under NEPP on 18--10--2007 on complletiion off
7 years serviice affter the BCR promotiion whiich iis treated as hiis ffiirst promotiion under NEPP..
iiii)) Some offffiiciialls who were Sr TOA iin DoT got request transffer to another recruiitment uniit affter 1--
10--2000 iin BSNL.. For techniicall reasons,, beffore theiir relliieviing on transffer they were reverted as
TOA and affter some tiime affter theiir jjoiiniing iin the new uniit they got Sr TOA scalle agaiin.. Such
offffiiciialls were iin Sr TOA pay scalle siince 1--10--2000 to 1--10--2004 except ffor a short break periiod
when they were iin TOA scalle.. They are to be decllared as elliigiiblle ffor the ffiirst upgradatiion under
NEPP on 1--10--2004,, iignoriing the break periiod.. Examplle:: An offffiiciiall who was iin Sr TOA cadre iin
DoT was transfferred ffrom one ciirclle to another ciirclle on hiis request and was reverted on 6--6--
2002 to TOA pay scalle beffore hiis relliieff.. The offffiiciiall jjoiined iin the transfferred ciirclle on 7--6--2002..
He was agaiin giiven Sr TOA scalle on 2--12--2002.. IIt iis requested to allllow ffiirst upgradatiion under
NEPP to the offffiiciiall on 1--10--2004..
iiiiii)) The driivers’’ pay scalle was upgraded ffrom 3050--4590 to 3200--4900 as per the reviised RRs,, wiith
effffect ffrom 28--1--2002 and allll the Driivers iin the ordiinary grade were pllaced iin thiis upgraded
scalle.. No agreement iis there between management and uniion to count such pllacement on
account off change iin RRs as the ffiirst up gradatiion under NEPP.. Such upgradatiion due to changes
iin RRs are not personall upgradatiion off the partiicullar offffiiciiall.. IIt iis the cadre that iis upgraded.. The
promotiions under NEPP are personall upgradatiions.. Thereffore such cadre upgradatiion shoulld not
be counted as upgradatiion under NEPP.. Hence allll these offffiiciialls be giiven theiir ffiirst upgradatiion
on 1--10--2004 siince they are iin the same basiic cadre pay scalle ffrom 1--10--2000 to 1--10--
2004iirrespectiive off the change iin the scalle on 28--1--2002..

diid not compllete the two year probatiion periiod and hence not elliigiiblle ffor appeariing iin the
examiinatiion.. But as per the Recruiitment Rulles off Tellecom Mechaniics off 2002 ciircullated viide BSNL
CO No.. 250--74/2001--Pers--IIIIII dated 20--2--2002,, there iis no such proviisiion barriing the offffiiciiall who has
not complleted two years probatiion periiod ffrom appeariing iin the examiinatiion.. Moreover when even
the TSMs are elliigiiblle to appear iin the examiinatiion,, the JJSAs are automatiicalllly elliigiiblle iirrespectiive off
complletiion off probatiion periiod or not.. IIt iis thereffore requested to correct thiis cllariiffiicatiion so that
the JJSA iis giiven the due promotiion as TM..

the ciity are pendiing wiith BSNL/DoT siince a llong tiime.. For some cases the HRA iis to be granted on par
wiith the ciity and ffor some cases iit has to be renewed.. For examplle the case ffor renewall off HRA ffor
the staffff posted iin viillllage Porankii whiich iis wiithiin 8 km off Viijjayawada ((AP)) iis pendiing siince a llong
tiime iin DoT.. IIt iis requested to take necessary actiion ffor iimmediiate settllement off allll these cases..

ffew meetiings off the commiittee allso took pllace.. Thereaffter,, the Chaiirman off the commiittee has
stopped calllliing the meetiings.. IInfformalllly the Staffff Siide iis tolld that the Management does not want
any change iin the desiignatiions off the Non--Executiives.. IIt iis needlless to say that the Management had
agreed to change the desiignatiions off the Non--Executiives iin the fflloor off the Natiionall Counciill and
thereupon a commiittee was fformed to ffiind out new desiignatiions.. IIt iis unffaiir on the part off the
management to renege ffrom the deciisiion off the Natiionall Counciill,, to change the desiignatiions off the
Non--Executiives.. Hence,, meetiing off the Desiignatiion Commiittee may be calllled and the process off
iidentiiffyiing new desiignatiions ffor the Non--Executiives may be complleted..

Recruiitment Quota off the year 2008 are llyiing vacant..
There iis acute shortage off Tellecom Mechaniics iin H..P Tellecom Ciirclle.. Many smallll tellephone
exchanges are not properlly manned.. Beiing hiilllly area,, iit takes llot off tiime off iiff a TM iis deputed ffrom a
nearby area to attend the ffaullt.. Thereffore,, the 135 Tellecom Mechaniics posts bellongiing to the Diirect
Recruiitment Quota off the year 2008 may be converted iinto Departmentall Quota.. No ffiinanciiall
iimplliicatiion iis iinvollved iin thiis conversiion.. But iit wiillll go a biig way ffor a hiilllly ciirclle lliike Hiimachall
Pradesh to iimprove the qualliity off our llandlliine serviices..
15.. TTA LIICE – requestiing to amend the RR to iincorporate the proviisiion to conduct
pre--qualliiffyiing screeniing test
As per the Recruiitment Rulles off the cadre off TTA,, offffiiciialls bellongiing to the cadre off TOA,, Sr..TOA,,
Tellecom Mechaniic etc..,, shoulld possess 10+2 qualliiffiicatiion ffor appeariing the LIICE.. Among the
emplloyees off the above mentiioned cadres,, especiialllly iin the Tellecom Mechaniic cadre,, there are a
good number off offffiiciialls capablle off gettiing through the TTA LIICE,, but who do not possess 10+2
qualliiffiicatiion.. IIn the past,, two LIICEs were conducted,, one maiin LIICE and llater on a suppllementary
LIICE.. On both those occasiions,, pre qualliiffyiing screeniing tests were allso conducted.. The non 10+2
offffiiciialls who passed the pre qualliiffyiing screeniing tests were allllowed to appear the LIICE.. Thus,, a
siizeablle number off emplloyees bellongiing to the non 10+2 category have passed the LIICE iin the past..
As a resullt off thiis experiience,, the Staffff Siide has consiistentlly been demandiing that necessary
amendment to the Recruiitment Rulles off the TTA shoulld be done,, to iincorporate the proviisiion off
holldiing a pre--qualliiffyiing screeniing test ffor the non 10+2 candiidates.. The Staffff Siide has been assured
that thiis amendment woulld be done beffore holldiing the next LIICE.. Hence,, iit iis requested to make
necessary amendment iin the Recruiitment Rulles off the TTA cadre,, iincorporatiing the proviisiion to holld
a Pre Qualliiffyiing Screeniing Test ffor the non 10+2 offffiiciialls..
16.. Amendment to Tellecom Mechaniic Recruiitment Rulles
As per the Recruiitment Rulles off the cadre off Tellecom Mechaniic,, iissued viide BSNL Lr.. No..250--
74/2001--Pers--IIIIII dated 20..02..2002,, the educatiionall qualliiffiicatiion prescriibed requiired to appear the
Tellecom Mechaniic LDCE iis 10tth standard.. However,, as per the cllariiffiicatiions iissued by Corporate
Offffiice,, viide lletter no.. BSNL Lr.. No..250--8/2009--Pers--IIIIII((Part--3)) dated 29..01..2010,, iit iis stated that no
educatiionall qualliiffiicatiion iis requiired ffor the Group D emplloyees.. Thus,, no educatiionall qualliiffiicatiion iis
requiired ffor a Group D emplloyee to appear the Tellecom Mechaniic LDCE,, whereas,, a Regullar
Mazdoor iis requiired to possess 10th standard qualliiffiicatiion ffor appeariing the same examiinatiion.. Thiis
condiitiionalliity,, llaiid down by the Corporate Offffiice,, iis strange to say the lleast.. A group ‘‘D’’ emplloyee
does not know anythiing about the dutiies off the Tellecom Mechaniic.. Whereas,, a Regullar Mazdoor
perfforms allll the dutiies expected to be perfformed by a Tellecom Mechaniic and possesses compllete
knowlledge about the dutiies and responsiibiilliitiies off a Tellecom Mechaniic.. IIn the recentlly conducted
LDCE off Tellecom Mechaniic,, many RMs who do not possess 10th standard qualliiffiicatiion were not ablle
to appear.. Thiis has created unnecessary hardshiip to them.. RM and Group ‘‘D’’ cadres are consiidered
to be equiivallent cadres.. Hence,, when no educatiionall qualliiffiicatiion iis requiired ffor a Group ‘‘D’’
emplloyee to appear the Tellecom Mechaniic LDCE,, the same condiitiion shoulld applly to the Regullar
Mazdoor allso..
Nowadays,, no tellecom Mechaniic post iis beiing created,, due to the declliine iin the number off llandlliines..
Allll the remaiiniing TM vacanciies may be ffiilllled up iiff one more LDCE iis conducted.. Hence,, the RMs who
do not possess 10tth standard qualliiffiicatiion may be giiven one llast chance to appear the Tellecom
Mechaniic LDCE.. For thiis,, Necessary amendment may be made to the Tellecom Mechaniic Recruiitment
Rulles,, so that the Regullar Mazdoors need not possess 10th standard qualliiffiicatiion ffor appeariing that
exam..

Government on the one side is asking BSNL to provide landline/mobile services in the remote and village areas as per its commitment to universal service. But on the other side it is not prepared to subsidise BSNL for the huge loss being caused by providing service in these loss making areas.( Private companies are not providing any service in local areas, because of the loss.)

But the DOT/Government is not prepared to give sufficient subsidies / fund to compensate BSNL. This is completely unfair and injustice.

BSNL has claimed about Rs. 4,000 crore towards this as per reports. But the government is yet to take a favourable decision. Government should stop this anti-PSU line and give the required subsidy with out any delay.

BSNLEU is very firm that the one day strike should take place as per schedule. Earlier, the JAC unanimously decided to go on one day strike on 10-10-2011. Since NFTE expressed it’s willingness to join the strike and desired for a change in the date, the strike was deferred. Thereafter, the JAC met and unanimously decided to go on strike on 15-11-2011. However, before fixing the date, JAC Convenor telephonically consulted NFTE and they gave their consent for it. Now, NFTE has written a letter to the Convenor, JAC, stating that “one day strike will not bring the desired result”. The letter is placed on NFTE website also. Many comrades are contacting CHQ and are enquiring about this. It is NFTE’s view. As far as BSNLEU is concerned, it is very firm that the strike should take place as per the JAC decision. Comrades are requested to go ahead with the strike preparations seriously.

It is learnt that the NE-12 file is yet to be cleared by the CMD and that he has sought certain inputs on the issue. Since CMD is out of station, he could not be met today. The issue will be discussed with him on Monday. General Secretary discussed the issue with Director (HR) today and urged expeditious settlement.

The CBI is scrutinizing crucial documents received from BSNL, on allocation of 323 high capacity telecom lines to the residence of former Telecom minister Dayanidhi Maran, that were allegedly used by Sun TV channel, owned by his brother Kalanidhi Maran. The CBI has alleged that these lines, used by medium to large commercial enterprises to meet special needs such as video conferencing and transmission of huge volume of digital data, for which heavy price is to be paid, were free for Sun TV.

TTA LICE : As per TTA recruitment rules only candidates with 10+2 qualification can appear the LICE. We have demanded that a qualifying screening test should be conducted for the non 10+2 candidates. A discussion on this subject has already taken place. We hope that our demand would be accepted.

Telecom Mechanic LDCE : As per the TM Recruitment Rules only RMs with 10^thstandard qualification can appear the LDCE. We have forcefully taken up that all RMs, without any qualification should be allowed to appear the Telecom Mechanic LDCE. But Management is reluctant to accept our demand. We would continue to persue this issue.

The National Convention held at New Delhi on 22^nd July, 2011, against the PFRDA (Pension Fund Regulatory and Development Authority) Bill, has decided to conduct a nation wide signature campaign against the bill. The signature campaign is to be conducted not only among the employees, but also among the general public. By passing the PFRDA bill in the parliament, the UPA government intends to privatize the system of payment of pension. The pension that our retired employees are getting is under serious threat. On Thursday the Supreme Court questioned as to why the Government allowed A. Raja to follow the first come first served policy. The Supreme Court pointed out that On 2^ndNovember, 2007, Prime Minister Manmohan Singh wrote a letter to the then Telecom Minister A.Raja, suggesting to follow a transparent methodology of auction for spectrum allocation. The Bench consisting of Justices G.S.Singhvi and H.L.Dattu further observed that the whole scam could have been prevented had timely action been taken by the government, instead of allowing A. Raja to follow the first come first served policy.

The report of the Anomaly Committee, that was constituted to settle the anomaly that arose in the 2002 wage revision, was not implemented fully. This issue was taken up in the last National Council. Management Side told that this situation arose because of the misunderstanding that has taken place due to some of the wordings in the report. In the discussion that took place in continuation of this, it was decided that the same Committee on anomalies will again meet and do necessary corrections to the wordings of the earlier report. Accordingly, the meeting of the Anomalies Committee is taking place on 17.10.2011. Com.V.A.N.Namboodiri, President and Com. P.Asokababu, Dy.GS are the Staff Side members of the Committee. After judgment is delivered by the Hon’ble CAT of the Ernakulam Bench, in the JTO LICE case, BSNL had filed an affidavit seeking a clarification. The clarification sought was that whether the reduction in the qualifying service from 10 years to 7 years is to be implemented retrospectively or prospectively. CHQ has been following up this case continuously for an early disposal. Now it is learnt that the hearing of the case is over and that the verdict is reserved. We hope that the verdict will come out soon and that the LICE would be held expeditiously.

The partial implementation of the anomaly committee report (Relating to the wage revision of 2002) was raised in the last National Council. It was replied that the needful would be done to implement the recommendations fully. GS, BSNLEU discussed the issue with GM (Estt.) on 03.10.2011. It was agreed that one more sitting of the anomaly committee would take place soon, to clear the ambiguity found in the report, so that the recommendations can be fully implemented.

The JTO LICE is being unduly delayed. The petition filed by BSNL, seeking clarification on the judgement of the Hon’ble CAT of Ernakulam has not received any reply. On 03.10.2011, GS, BSNLEU met the GM (Estt.) and expressed his concern over the undue delay in holding the JTO LICE. GM (Estt.) assured to take all expeditious measures to get early clarification from the Hon’ble CAT, so that the LICE could be held.

BSNLEU was invited by the management today, the 20-09-2011, for a discussion on VRS. Director (HR) and other senior officers took part in the discussion. Management gave a presentation on their proposed VRS scheme. In the discussion that took place after the presentation, leaders of BSNLEU firmly told the management that they oppose VRS of any type. They also pointed out that VRS scheme is absolutely not necessary to pull out BSNL from the present crises. Management was also told as to how the condition of MTNL did not improve even after implementing VRS three times. Our opposition to VRS will also be conveyed to the management through a letter. Com. [14.09.2011]No change in working hours pattern in BSNL

It appears that some confusion is created in respect of working hours, due to the clarification issued by Corporate Office yesterday, vide letter no.14-1/2011-TE dated 13.09.2011. There is nothing new in this clarification. It is only a consolidation of the already existing rulings. According to this clarification, there will not be any change in the present pattern of working hours in BSNL Offices.

[09.09.2011]Supreme Court order on reservation- a set back for the reserved category employees.

The Hon’ble Supreme Court of India has delivered a judgment on 08-09-2011, on the issue of reservation. The Hon’ble Court has held that reservation rules will not apply, where a candidate gets only higher pay scale, but continues to hold the same post without any change in duties and responsibilities. This judgment was delivered by a bench consisting of justices R.V.Raveendran and Markandey Katju. This judgment is a set back for the employees belonging to the reserved categories.

[09.09.2011]BSNL CO clarification on NEPP- a set back for the TSMs regularized on or after 01-10-2000.

BSNL CO has issued a clarification on NEPP, wherein it is stated that the TSMs regularized on or after 01-10-2000, will be treated only as BSNL recruitees , as far as NEPP is concerned. This clarification is based on a reply given by the DOT on the matter. BSNLEU has demanded that these employees, numbering around 15,000, should be treated as DOT recruitees, since they are already issued with Presidential Orders. CHQ will not accept this arbitrary order of the BSNL and will find ways and means to get justice for these employees. <>

The JAC, in it’s meeting held on 07.09.2011, vehemently opposed the curtailment of medical allowance, LTC and Leave Encashment, and called upon the BSNL employees to hold massive dharnas throughout the country on 14^th September, 2011. Circle and District Secretaries are requested to immediately arrange to hold meetings of the JAC at all places and plan to organise the dharna massively. The dharnas to be held on 14^th September shall be a befitting reply to the high-handeness of the management.

RESTORE THE WITHOUT VOUCHER SCHEME

FOR PENSIONERS

OUR DEPUTY GENERAL SECRETARY COM. CHHIDU SINGH IS PURSUING THE CASE VIGOROUSLY IN CORPORATE OFFICE OF BSNL. WE HAVE WRITTEN ANOTHER LETTER TO CMD POINTING OUT THAT HIS LATEST DECISION WILL INCREASE THE EXPENDITURE OF BSNL COMPANY AND IT WILL CREATE UNNECESSARY PROBLEMS TO THE SENIOR CITIZENS. HENCE, THE DECISION SHOULD BE REVERSED. ATLEST FOR PENSIONERS, THE WITHOUT VOUCHER SCHEME SHOULD BE RESTORED, WE HAVE REQUESTED. WE HAVE GIVEN SPECIFIC CASE ALSO. WORKING EMPLOYEES ARE GOING TO OFFICE AND HENCE IT IS EASY FOR THEM TO SUBMIT BILLS, VOUCHERS ETC. PENSIONERS HAVE TO TRAVEL FOR THE PURPOSE ALONE AND CARRY THE TENSION.

Subject: Withdrawal of facility to opt for reimbursement of medical expenditure without voucher for Outdoor treatment – Case of retired BSNL Employees.

Sir,

We are shocked to find that BSNL vide its Order No. 7-8/2010/EF/Part//1 dated 5.9.2011 has withdrawn the above facility which was available to its retired employees who are covered under the BSNLMRS. The step is taken in view of financial crunch.

2. We would like to state that the retired employees were mostly opting for “without voucher” system to meet the expenditure on outdoor treatment, though the permitted limit for reimbursement was even less than the amount that they are entitled to under the “with voucher” option. This was mainly to avoid the delay in settlement of their claims and also to avoid the repeated visits to the BSNL Office, to the Doctors etc. to pursue the claims for reimbursement. The Pensioners, because of growing age and bad health, should not be compelled to make unnecessary travels and carry the tension with them. Further, we would like to say that withdrawal of the above facility will not help BSNL to save any expenditure, but will certainly increase its financial liability only. The following example will explain the position:

A Sr. TOA in NE 10 scale while drawing basic pay of Rs 10500 plus 28.3% IDA retired in May 2001. He was entitled to Rs 6736 per year as medical allowance all these years since he opted for without voucher scheme. Now, if he changes over to With Voucher scheme he will be entitled to Rs 14900 (The minimum pay in new revised scale) plus 47.2% IDA from April 2011. His entitlement increased from Rs 6736 to 21933.00 per year.

Further, it will increase the work in SSA offices. The very purpose for which you have taken such a decision will definitely be defeated by the step.

3. We, therefore, request you to kindly reconsider the decision and restore the facility of ”without voucher” scheme at the earliest, at least in the case of BSNL pensioners.

MRS: "Without Voucher" to "With Voucher"

"Penny-wise; Pound-foolish" is the English saying

"Paisa-wise; Rupee- foolish" is the BSNL version of it.

BSNL Management has withdrawn the "without voucher" scheme and asked us all to change over to "with voucher" scheme. What is the imapact?

A Sr TOA in NE 10 scale while drawing basic pay of Rs 10500 plus 28.3% IDA retired in May 2001. He was getting the medical allowance of Rs. 6736 every year till now. After changing over to 'with voucher' he will be entitled to Rs 14900 (Minimum pay in his new revised scale of NE 10) plus 47.2% IDA effective from April 2011. His entitilement increases from Rs 6736 to Rs 21933 per year. I do not know whether the pandits in Corporate Office had done such studies before presenting the files to CMD.

Every case is not like this. However, the pensioners in general prefer without voucher scheme to avoid unnecessary travel to their SSA offices.

On our call, large number of Branches have sent resolution to CMD, BSNL requesting him to restore without voucher shceme in the case of pensioners. Poor pensioners aged 65 years or so should not be compelled to travel to their old offices several times to submit the bills and face humiliation. Total neglect of pensioners is reported from many places. We hope that CMD will look into the case and change the decision. BSNL's loss will only increase by the 'with voucher" scheme.

KERALA CIRCLE CONFERENCE

Kerala Circle Conference of AIBSNLPWA was held at Trichur on 11th October 2011. It was inaugurated by Com. K P Rajendran, EX Minister of Kerala and greeted by Shri. T V Chandramohan (INTUC Leader), P S Ramankutty (GS), T I Sudhakaran(General Secretary of Central Govt. Pensiones Association) and V Rama Rao (Circle Secretary, Tamilnadu). Com. D Gopalakrishnan, All India Vice President spoke elaborately on the organisational matters and issues we have taken up and settled as well as to be settled. 475 Delegates, including large number of Ladies, representing all the 11 SSA units in the Circle attended the Conference. The conference re-elected Com. V. Ramachandran,Retired SDE of Malappuram SSA as Circle President and Com. R N Padanair as Circle Secretary. The new Circle Executive Committee consists of 4 lady comrades and 8 Retired Executives.

PENSION REVISION:

DIRECTORATE WANTS DATA FROM CCAs

We have been bringing to the notice of Secretary, Telecom and the Honourable Minister for Communications the inordinate delay in revision of pension of BSNL pensioners retired before 1-1-2007 and after that date too. Now, the Directrorate has asked all CCAs to send the particulars of cases received, disposed and returned. The letters issued by DoT and BSNL are given in IMPORTANT ORDERS. Serial Nos 54 and 55.

ANOMALOUS ORDER

The order issued by DoT on 27th September 2011 and endorsed by BSNL on 11-10-2011 for 'removing anomaly in pension of those who retired during the first ten months after formation of BSNL' are given in IMPORTANT ORDERS. Serial No 56 and 57. This will not help any single pensioner facing the anomaly. We are still pursuing the case. Further action will be decided by CEC meeting to be held at Vijayavada in November 2011.

DOT (CENTRAL GOVT.) PENSIONERS, PLEASE NOTE.....

Government of India accepted 6th CPC report and issued order on 2-9-2008 to revise the pension of central govt. pensioners. Three years have passed. But, according to the reports received from various Departments by the Central Pension Accounting Office (CPAO), only 10-15% of the 38 lakhs pensioners received revised pension during the last three years ! What a pity !!!!

Some Departments like Department of Posts, Department of Telecom have not supplied the information even. Now the CPAO under Department of Expenditure is giving advertisements in newspapers asking the Pensioners to submit certain information within one month.

Those DoT Pensioners who already received the revised pension with effect from 1-1-2006 need not send the information. If anyone has not received it - especially the family pensioners - such people should send the required information to the Head of Office from where the pensioner retired.

We have received enquires from number of central pensioners, after seeing the advertisements by CPAO, in this regard. Hence the above explanation.

JAC- BSNL MANAGEMENT MEETING

JAC leaders met the Director (HR), BSNL Board on 3-10-2011 and discussed major issues. The results are, according to the Note published by BSNLEU:

1. Bonus to serving staff

Bonus shall not be granted to staff this year also because the Company is in loss.

2. Curtailment of MRS and LTC

The order shall not be withdrawn.

3. VRS

The order shall not be withdrawn.

4. BENEFIT OF 50% DA MERGER

Benefit of 78.2% DA can not be given in pay fixation, Benefit of DA merger is thus denied categorically.

IDA RATE FROM OCTOBER 2011

The All India Consumer Price Index for August 2011 is 194, declared by Labour Bureau. Accordingly, the rate of IDA shall increase by 4.8% with effect from 1-10-2011. From existing 47.2% to 52% total. This is for BSNL working staff and BSNL pensioners who got the revised pension.

In the case of other PSU pensioners who do not get any pension revision the rate is increased by 8%; from 148.6% to 156.6%.

ANOMALY ORDER: NOTHING NEW

DOT has issued the order for removing anomaly in pension of those who retired during October 2000 - June 2001. Pension can be revised which shall not be less than 50% of the minimum pay in the new corresponding payscales. There is nothing new in it. This provision is there from 1996 itself. Same provision was incorporated in the order dated 15th March 2011 issued by DOT for our pension revision.

Then what is the use of giving same instruction once again? Strangely, the DOT administration even now pleads that the new order will remove all anomalies! It will not remove the anomaly of a single pensioner in BSNL.

We have approached the Communication Minister to intervene in the matter. If that attempt also fails, then, there is no alternative but to go a legal fight because same DoT Directorate had removed similar anomaly in the past using another method. They can not deny justice to 4000 pensioners who retired immediately after formation of BSNL who were not given any idea about IDA payscales etc before they retired. Our Vijayavada CEC meeting will discuss the matter and take a decision.

We shall not leave the matter here. We will continue our fight for justice.

ANOMALIES: SOME OTHERS CLAIM THE CREDIT

When the Dirctor informed our Dy GS that permission is given by Department of Pension to Department of Telecom to remove the anomaly in pension of BSNL staff retired during the first nine months since formation of BSNL in 2000, we placed the matter in this website hailing it as an achivement. Now, someone who is always copying the writeup of others (copy and paste editor?) and taking credit for everything, is ridiculing us.

I am not for any controversy over the matter concerning large number of pensioners. Let anyone take the credit for the achievement. I am for a good settlement.

We are working as All India Association for just two years only. Others are working and writing letters for many many years. Why then this particular ten years old anomaly was not settled by them?

When we found that DoT was not taking any action on it for want of DATA from circles, we asked the affected pensioners to send individual representations to Secretary, DoT. WE SENT A DETAILED LETTER WITH SPECIFIC CASES TOO. See our Patrtika No 3 issued in July 2011.

Good number of people sent the representations. Thereafter, the DoT moved. Eventhough the Finance wing in Directorate did not agree the case was referred to Department of Pension on our insistance.

Now, the permission is granted by Pension department. Still, there is a hurdle. The Finance wing in Telecom has to clear it. I do not know how they will interpret the letter from Pension Department and wet the order. Our past experiences compel me to doubt. I am still waiting to see the actual order.

There are some other people who do not like a settlement in the case because they could not settle it earlier.

Pension revision of re-employed Ex Servicemen is not settled beause of certain conditions imposed by DoT in the order dated 15th March 2011, contrarary to the decision of Department of Pension of floor ceiling on minimum pension.

THE INDIAN TELECOM "WISDOM"

MTNL introduced VRS four times. Expenditure on salary was reduced. But the loss of MTNL increased from Rs. 450 crores in 2010 to Rs. 850 crores in 2011. Now the senior officers want to merge this loss incurring MTNL with loss incurring BSNL!

(-) 6000 Crores + (-) 850 crores+ ? ..... Will it make profitable?

The Wise men in Bharat Sanchar Bhavan save Rs 50 crore or Rs 60 Crore by curtailing BSNLMRS for pensioners and add loss of Rs 850 crore per year! .

According to the Parliamentary Standing Committee,

DOT & BSNL did not utilize the funds allocated in Budget by the Government.

In 11th Plan period the Govt. had allocated Rs 1,03,526.96 crores. But the DOT & BSNL utilised only Rs 41,676.36 crore. Just 40%

In the year 2010-1, only 3% of the original budgetary allocation was utilised by DOT/BSNL.

During the last four years BSNL did not procure a single GSM equiment for mobile expansion.

Present CMD says ; "We lost not just four years but an era of expansion"

How can BSNL or MTNL perform well under such Management? What is the use of merging of MTNL with BSNL except increasing the loss?

What is the use of VRS?

ITS ABSORPTION IN BSNL

FOR THE LAST LONG 11 YEARS, THE ITS OFFICERS RESISTED ABSORPTION IN BSNL. THEY, BEING AT THE HELM OF AFFAIRS, KNEW VERY WELL THAT BSNL WOULD BE LIQUIDATED ONE DAY OR THE OTHER. THEREFORE I T S OFFICERS SITTING IN SANCHAR BHAVAN AND BHARAT SANCHAR BHAVAN JOINTLY WERE PLAYING A GAME ALL THESE YEARS. AS A LAST RESORT THEY WENT TO THE COURT. ALL ATTEMPTS FAILED.

NOW, DOT HAS ISSUED ORDERS ASKING THE ITS OFFICERS TO OPT FOR OR OPT OUT OF BSNL. THE OPTIONS SHOULD REACH DOT BY END OF NOVEMBER 2011.

LEARN IT FROM BIHAR...

Com. A K Singh, our Circle Secretary of Bihar informs that all the 3000 cases for pension revision received by the CCA of Bihar have been cleared by the DOT Cell. Not a single case is now pending in CCA office, Patna. [Ofcourse, there is delay in further action by Postal Accounts authorities. 25% of the pensioners only have received the money. Others are waiting.]

Contrast to the above, None repeat None retired from BSNL Corporate Office has received the authorisation letter till today. The BSNL retirees of Corporate Office are the victims of the great 'work culture' in their office.! We regret much to observe it.

VRS: BSNLEU OPPOSES THE PROPOSAL

BSNLEU was invited by the management today, the 20-09-2011, for a discussion on VRS. Director (HR) and other senior officers took part in the discussion. Management gave a presentation on their proposed VRS scheme. In the discussion that took place after the presentation, leaders of BSNLEU firmly told the management that they oppose VRS of any type. They also pointed out that VRS scheme is absolutely not necessary to pull out BSNL from the present crises. Management was also told as to how the condition of MTNL did not improve even after implementing VRS three times.

We understand that some people in Chennai have issued a Tamil circular quoting us, as if we issued it. It is not correct. We have not issued any circular. We are yet to study the proposal in depth.

We are astonished to see that some other people are justifying the proposal! They are interested to save the Management which is dividing the Unions.

Those who opt for the VRS may get some fringe benefits.

It is like garlanding the goat before choppping of its head.

Management shows exaggerated figures as benefits. The usual retirement gratuity, Encashment of leave, commutation etc. etc. are included in it. Staff should not be misled by such tactics.

Management curtailed MRS, LTC saying that Company has no money. Now they are introducing a VRS costing Rs. 20,000 crores !

VRS for BSNL employees proposed !!

The BSNL Management has submitted to the Communications Minister on 12th instant a Voluntary Retirement Scheme for its staff. The 58 pages document gives lot of information. Some of the important features are;

1. All employees above the age of 45 years can opt for VRS.

2. Two months salary (Basic Pay + DA) for every year of service already rendered

or salary for for the remaining period, whichever is less, will be given as VRS benefit.

3. One lakh employees (including Group A, B, C and D) are expected to take VRS, according to the Management.

4. BSNL wants a grant of Rs 11,276 crores from the government to introduce the Scheme.

5. Documents says that the employees can start business or take employment somewhere else after taking VRS. Where?

There was no disucssion with the 'RECOGNISED UNION'. They were not told of it.

We will study the scheme in depth and offer our comments. We are waiting to see what the recognised union leaders decide. Now they are meeting at Jaipur in the CWC. They are more interested to use the Buliding Fund. Purchase the building immediately, Let the workers face any problems.....

CMD has told the leaders of JAC on 14th instant that they should expect more cuts in the near future.

MARCH TO PARLIAMENT ON 25th NOVEMBER 2011.

Shri Shyamsunder, Secretary General of BCPC (Bharat Central Pensioners Confederation) informs that BCPC is organising a March to Parliament of pensioners and workers protesting against the PFRDA Bill as well as asking settlement of major 13 demands of central service pensioners. It will be on 25th November 2011. Details will be communicated later on.

Our CHQ call upon our members in Delhi and nearby states like Punjab, Haryana, UP, Rajastan and MP to partcipate in the March enmasse.

DA = Disturbing Allowance?

Today, I received lot of frantic calls from both pensioners and serving staff about the IDA rate from October 2011. I could not give any definite reply today. The Price Index for August 2011 will be released only on 30th September. That is the arrangement. Without knowing the official figure supplied by Statistical Commission of India nobody can calculate and tell you what exactly the rate of DA would be from 1-10-2011.

I know the reason for the frantic calls. GOvernment has decided to raise the CDA rate by 7% with effect from July 2011 and there was no increase in IDA from that date. This fact disturbed many people. Is there is any mistake in the calculation? That is the enquiry.

The Price Index is prepared for CDA and IDA in the same manner only. But the CDA is granted on the basis of 12 monthly average and IDA on three monthly average. That causes the difference. We need not be distrubed because central govt staff and pensioners get some DA. They will also be adversely affected next time when the 12 monthly average from January to December 2011 is taken.

But there is really a big fraud committed in the matter of DA. You will find an article on it in the ensuing issue of our Patrika. The method of collection of Data is fraudulent. Please read the article.

IDA not increased why?

Average Price Index for December(2010) to February 2011 was 186. Average for March-May also remained same at 186. Hence no increase from July. Now, Average for June-August will be taken into account to determine the IDA rate from October 2011. The figure for July was 193. If it is same 193 for August then there will be an increase of 4.5% in IDA from October. If the figure for August is 194, then there will be increase of 4.8%. If the figure is 195, then the increase will be 5%. Let us wait to know the official figure to be released on 30th of this month.

Do Not worry much about the DA rate. Price Rise is the real issue which must disturb us.

INEFFICIENT CORPORATE OFFICE !!

BSNL Corporate Office issued instructions to all on 4th April 2011, endorsing the Pension Revision order of DOT, that BSNL offices should revise the pension and forward calculation sheets to DOT before 30th April 2011. But the Corporate Office itself did not adhere to the time schedule! There are only 199 people retired from Corporate Office and eligible for the pension revision. April had gone, May, June, July and August also. The Corporate Office forwarded the Calculation sheets of 195 people - including retired CGMs, DDGs, etc. - only on 15th September 2011. (Some SSAs having more than 1000 pensioners could complete the work by end of June.)

WONDERFUL EFFICIENCY OF CORPORATE OFFICE ! ! ! !

CO fails to reply to letters in time. It does not issue clartification sought from field offices.

Field offices do not care the order of this Corporate Office.

In MP Circle, 25 SSAs have not yet forwarded the revision cases to CCA.

In Maharastra Circle, majority of SSAs have not prepared the calculation sheets even today. In Nagpur PGM's office they can not trace out the Service Books of even senior officers retired recently.

How can BSNL grow under such inefficient management?

HOLD GB MEETING AND SEND RESOLUTION TO THE CMD, BSNL.

We do not find any joint action by Service organisations of BSNL staff against curtailment of BSNLMRS and LTC facilities. We do not like to join any programme being organised by them separately. Hence, we call upon our District Units and branches to hold General Body meetings and send resolution to CMD, BSNL requesting that the 'without Voucher' scheme should be restored to the pensioners considering their age and health conditions. Sir,

We are shocked to find that BSNL vide its Order No. 7-8/2010/EF/Part//1 dated 5.9.2011 has withdrawn the above facility which was available to its retired employees who are covered under the BSNLMRS. The step is taken in view of financial crunch.

3. We, therefore, request you to kindly reconsider the decision and restore the facility of ”without voucher” scheme at the earliest, atleast in the case of BSNL pensioners.

PENSION REVISION PROGRESS

According to the feedback received from Circle Secretaries, the revision work is almost completed by the DOT Cells in Punjab, Haryana, NTR, Chhatisgarh, UP West, Bihar, Orissa and West Bengal circles. More than 30% have been disposed in Karnataka, Tamilnadu, AP circles. Rajastan and Gujarat have cleared 60% cases. The position in Kerala, MP, Maharastra, UP East, Assam circles is quite unsatisfactory.

ACCORDING TO THE CIRCULAR No 5 OF 2011 ISSUED BY INCOME TAX CEPARTMENT, THE iNCOME TAX RATE FOR THE CURRENT FINANCIAL YEAR FOR SENIOR CITIZENS

(ABOVE THE AGE OF 60 YEARS) IS:

UPTO 2.5 LAKHS ........ NIL

ABOVE 2.5 LAKHS AND UPTO 5 LAKHS ........ 10%

ABOVE 5 LAKHS, UPTO 8 LAKHS ........ 20%

ABOVE 8 LAKHS ....... 30%

CIRCLE SECRETARIES PLEASE NOTE;

The target date for paying new pension and arrears is 30th of this month. Except three or four, no Circle has completed 50% of the work. Many pensioners will not get the new pension and arrears before the target date. We want to take up the matter with Minister for Communications. Therefore, Circle Ssecretaries are requested to supply the following figures as on 10th September 2011:

1. Total No. of BSNL Pensioners retired prior to 1-1-2007

2. No of cases in which sanction memo is issued by the CCA.

3. No of BSNL pensioners retired after 31-12-2006 and waiting for revision

BSNLMRS, LTC CURTAILED....!

BSNL Corporate Office has issued order yesterday withdrawing BSNLMRS without Voucher scheme. Employees and pensioners can change over to With voucher Scheme for the remaining six months from October 2011.

Leave Encashment along with LTC is also withdrawn from 1-10-2011.

All India LTC is frozen for two years.

Let us see what the 'Recognised Union" leaders and other organisations do in the case.

Last year, Bonus was denied. Nothing was done.

Some people argue that pensioners should go along with only the 'recognised' people to proterct their interest. This is how they protect.

FIRST, THE RECOGNISED UNION SAID THAT THERE WAS NO SUCH PROPOSAL. NOW, THE ORDER IS ISSUED. ANYWAY, RECOGNISED UNION IS ORGANISING SOME PROTEST DEMONSTRATION ON 7TH. IT IS NOT ENOUGH.

WHAT ABOUT OTHER ORGANISATIONS? NFTE HOLDS DEMONSTRATION TODAY. FNTO HOLDS IT ON 13TH. UNFOTRTUNATELY, THERE IS NO JOINT ACTION. NONE HAS SOUGHT OUR COOPERATION. HENCE, OUR CHQ IS NOT ISSUING ANY CALL NOW. OUR MEMBERS ARE FREE TO JOIN ANY PROTEST PROGRAMME ACCORDING TO THEIR CONENVEINCE.

ALL THE ORGANISATIONS OF BSNL STAFF AND PENSIONERS SHOULD JOIN TOGETHER AND DEFEAT THE MOVE OF THE MANAGEMENT TO CURTAIL EXISTING FACILITIES EVEN WITHOUT ANY DISCUSSION WITH STAFF LEDERS.

PENSION REVISION

Com. Narsimhani, Circle Secretary of UP West informs that out of 1600 cases received, 1406 have been cleared by CCA of UP West. Out of the remaining 36 cases are dispouted due to some disciplinary cases etc. Few SSAs have not yet forwarded the cases to DoT Cell.

Com. Moitra, C/S of West Bengal informs that out of 2500 cases 1900 are cleared by the DoT Cell in WB Circle.

In AP Circle, 1600 people got the order. In Karnataka and Kerala too few more people recd the orders. I am waiting for definite information from other Circles.

Internet connection to my computer is disturbed for the last three four days and hence I could not upload the Site.

I AM ANNA ..... I AM ANNA.....

Thousands of people - ordinary people from villages, youth, women, lawyers, employees, pensioners etc. etc. - wear the caps with the above slogan and demonstrate their support and solidarity to the struggle undertaken by gandhian Anna Hazare against corruption. Some of these people may not know details of the Lokpal Bill and Jan Lokpal Bill. But, onething is certain. They are all fed up with the corrupt system. They have seen Rajas, Marans, Kalmadis... and many others like those. That is why thousands of people are in Ramlila ground now. Some people say that "Anna is a Gandhian, the form of his struggle is gandhian, but His demands are not gandhian. Parliament can not be ignored..." May be. But the people back him. They know that he is different from Ram Devs.

Anna Hazare could bring the issue of corruption to the brain of every Indian. With a Bang! That is great. Most unfortunate is that we have a government without a mature leadership. It lost its face. The main opposition party is also not different. It is unable to openly support Anna Hazare. It has no leaderwship with a nationalist outlook. The Left is left out. People find no alternative.

We are for a corruption-free system. We support Anna Hazare's crusade against corruption.

I WAS ON TOUR FOR THE LAST ONE WEEK TO ATTEND SOME DISTRICT CONFERENCES IN KERALA. 8 OUT OF THE 11 SSA UNITS HAVE COMPLETED THEIR CONFERENCES. KERALA CIRCLE CONFERENCE IS FIXED FOR 11TH OCTOBER 2011.

SYSTEMATIC WORK IS REPORTED FROM DELHI NTR, KARNATAKA AND ANDHRA. TAMILNADU CIRCLE YET TO PICK UP. FEW PEOPLE GOT THE ORDERS IN UP (EAST), KERALA aND ASSAM TOO. THE RESULTS, IN GENERAL, ARE NOT ENCOURAGING.

UNFORTUNATELY, THE WORKING EMPLOYEES ARE VERY MUCH LETHARGIC TOWARDS OUR ISSUES. NON OF THE VARIOUS UNIONS / FEDERATIONS/ ASSOCIATIONS OF WORKING STAFF HAS GIVEN ANY CALL TO THEIR MEMBERS TO EXPEDITE THE REVISION WORK. IT REFLECTS THEIR ATTITUDE TOWARDS PENSIONERS. THE LEADERS SHED LOT OF CROCODILE TEARS FOR US; BUT DO NOTHING PRECIOUS.

ANDHRA CIRCLE MOVES AHEAD

COM. KOTESWARA RAO, OUR CIRCLE SECRETARY OF AP CIRCLE INFORMS THAT PENSION REVISION AND ARREARS PAYMENT ORDERS WERE ISSUED TO 1227 PENSIONERS IN ANDHRA TILL 12TH AUGUST 2011.

FULL PENSION AFTER TEN YEARS OF SERVICE

NO PRO-RATA PENSION SCHEME NOW IN TELECOM

Earlier, DOT had issued order on 16th August 2010 and a clarification to CCA, Bangalore, with copy to all CCAs, that BSNL staff retiring on superannuation after completion of 10 years service are entitled to full pension. But those who take voluntary retirement will get full pension (50% of last pay drawn) only after completion of 20 years service. If the pensionable service is less than 20 years, then, they are eligible to pro-rata pension only. Some affected officials from Hyderabad and Madhya Pradesh brought this case of discrimination to our notice.

Our Association took up the matter and pointed out that in Railways there is no such discrimination. There, in the case of VRS also full pension is granted on completion of 10 years service. (See Page 20 of our Journal of January 2011.) Now, DoT has issued a new order ending the discrimination. BSNL endorsed the same vide their letter No. 40-22/2011-Pen(B) dated 10-8-2011.

Anyone retiring after 1-1-2006, on superannuation or under VRS, after rendering ten years of pensionable service is eligible to get 50% of last pay drawn. There is no pro-rata pension scheme now. The concerned pensioners may please take note of it and submit applications to respective CCA for full pension. The DoT order will be published in next issue of our Patrika.

The All India Consumer Price Index for August 2011 is 194, declared by Labour Bureau. Accordingly, the rate of IDA shall increase by 4.8% with effect from 1-10-2011. From existing 47.2% to 52% total. This is for BSNL working staff and BSNL pensioners who got the revised pension.
