 Sub: - Proposal for solving the problem of stagnation which has become very severe especially in the case of RM and other group D employees—Reg. Ref: -
(1) DPE Order No.2(70)/08-DPE(WC)-GL-VII/09 dated 2.4.2009, (2) Clause 6.2 and 6.4 of the Wage Revision Agreement signed by the management with BSNLEU and circulated vide BSNL No.BSNL/38-1/SR/2009 dated 7.5.2010 (3) Order No. 9637-F dated 26.9.2002 issued by the Finance Department, West Bengal Government. 1. This is to submit that the problem of stagnation is creating a lot of dissatisfaction and unrest in the BSNL employees now. Almost all RMs and other group D employees have reached maximum of the scale/drawing stagnation increment etc and even those senior RM who were promoted to TM are facing stagnation. Even many of the Sr ToAs will reach their scale maximum in 2016. 2. Prevailing of such a huge level of stagnation is an aberration. Also, in several cases, when the official becomes due for stagnation increment and also due for NEPP promotion in the same year, he was deprived of the benefit of both stagnation increment as well as promotion increment, as detailed afterwards in this letter. This is also a serious aberration. The following case illustrates this: “Sri Mohammad Sarwar RM (HRMS No. 199303274) Hyderabad Telecom District (AP Circle); Date of appointment: 1.4.1993 as RM: Retirement on 31.1.2020. On 1.10.2000 his basic pay in NE-1 pay scale (4000-120-5800) was fixed at Rs 4840. His date of increment was 1st January and on 1.1.2004 he was fixed at Rs 5320. He was given NEPP-1 to NE-2 pay scale 4060- 125-5935 and his pay in the NE-2 pay scale was fixed on the date of his next increment 1.1.2005, at Rs 5560. On 1.1.2006, after drawal of annual increment, his basic pay was fixed at Rs 5685/-. Due to wage revision, his basic pay was fixed at Rs 13570/- in the revised NE-2 pay scale 7840-14700 on 1.1.2007(including increment on 1.1.2007). He reached maximum of the NE-2 pay scale Rs 14700/- on 1.1.2010. He was due for one stagnation increment on 1.1.2012. With this stagnation increment his pay on 1.1.2012 should be Rs 15150/-in the pay scale 7840-14700. But he was due for second NEPP in the next higher pay scale NE-3 (7900-14880) w.e.f 1.10.2011. Accordingly he was given the said NEPP-2 promotion. He opted for pay fixation in the promoted NE-3 pay scale from the date of his next increment 1.1.2012. But on 1.1.2012 he was due for stagnation increment in the NE-2 pay scale and should be fixed at Rs 15150/- and one notional increment on it should have been added on it on account of his promotion to NE-3 pay scale. By adding this notional increment on Rs 15150, his basic pay in NE-3 should have been fixed at Rs 15610/-. Since the maximum of the NE-3 pay scale was Rs 14880/- only, he was fixed at Rs 14880/- on 1.1.2012 instead of Rs 15610/-. Thus he lost the benefit of stagnation increment (with which his basic pay should be Rs 15150/-) and the benefit of notional increment of 3% on promotion. This is a serious aberration.” 3. These aberrations are due to the adamant attitude of the management in not agreeing for the revision of pay scales with effect from 1.1.2007 based on 78.2% IDA merger initially and constructing the pay scales based on 68.8% IDA merger only. Even though the Union went on two days strike demanding pay revision based on 78.2% IDA merger as per the DPE Order No.2(70)/08-DPE(WC)-GL-VII/09 dated 2.4.2009, the management did not agree. Thus the management itself created a special situation by violating the DPE order. 4. After thus refusing to agree for wage revision based on 78.2% IDA merger and imposing pay scales based on 68.8% IDA merger only, the management came forward finally to agree for the following points in the wage revision: i) To consider wage revision based on 78.2% DA merger, along with the executives(clause 6.4 of wage revision agreement) ii) To address the anomalies/aberrations arising out of the wage revision( clause 6.2 of the wage revision agreement) 5. Subsequently the management agreed and implemented pay fixation based on 78.2% IDA merger. But the problem of stagnation became more severe with it. Since the aberrations arose due to the refusal of the management to revise pay scales based on 78.2% IDA merger and since the management has agreed to settle such aberrations, it is the responsibility of the management to find out a solution for solving this problem. 6. However, we submit the proposal that stagnation increment be granted every year instead of once in two years. We also submit that in the case of promotion to the next higher scale where the maximum is less than the pay already drawn by the official including stagnation increment in the lower scale, the excess over and above the maximum of the promoted pay scale be treated as stagnation increment in the promoted pay scale and there after stagnation increments be granted in the promoted pay scale every year. 7. We submit the following grounds for supporting the above proposal: a) The continuation of the problem of stagnation in the case of BSNL employees who are eligible for Government pension is untenable since the stagnation problem was already removed by the orders issued by the Government based on 6th CPC recommendation that the official who reaches maximum of the pay scale will be granted increment in the next higher pay band. The 7th CPC recommended levels of pay instead of pay scales and each level has a span of 40 years from minimum to maximum and even then it said these minimums and maximums should not be treated as minimum and maximum of a pay scale. b) In spite of this, pay scales with minimums and maximums were imposed by BSNL management on the plea that for calculating the pension contribution to be paid by BSNL to DoT for the absorbed employees, the pay scale should have maximum since pension contribution has to be calculated based on scale maximum. On this ground, the management refused the proposal of the Union in the wage revision for open ended pay scales without any maximum. It only agreed after a lot of struggle, to increase the span of the pay scale from 15 to 21/22 years although Union demanded at least 25 years span. Therefore the management caused an injustice on the low paid employees by imposing this stagnation on a large scale, although as employees eligible for central government pension, they also should not have the problem of stagnation on par with the central government employees. c) As detailed above, the management violated the DPE order dated 2.4.2009 by refusing to grant pay scales based on 78.2% IDA merger and by imposing pay scales based on 68.8% IDA merger, although it subsequently corrected this partly and revised the pay (but not the pay scale)based on 78.2% IDA merger, and it further increased the problem of stagnation. d) The management has to fulfill its assurance in the wage revision agreement to address all aberrations as detailed above. e) To settle the problem of stagnation, the then Left Front Government of West Bengal issued orders allowing six stagnation increments annually after reaching the maximum of the pay scale. It further ordered that the excess of the pay fixed on such promotion over and above the maximum of the promoted pay scale has to be treated as the first stagnation increment in that promoted pay scale and he will draw further stagnation increments in that scale annually, subject to the maximum ceiling of 6 stagnation increments. [Reference: Order No. 9637-F dated 26.9.2002 issued by the Finance Department, West Bengal Government] f) From 1.4.1996, maximum five stagnation increments were given annually by the Karnataka State Government. g) Thus the procedure of granting stagnation increment annually is already there in some State Governments where as the problem of stagnation is not at all there in the Central Government.BSNL employees alone should not be targeted and punished with stagnation and since they are eligible for government pension, the same principle of no stagnation as available in central government must be available to them. h) BSNL management already violated DPE order by not granting 78.2% IDA merger in wage revision initially and based on such refusal, further refused to construct the pay scales based on 78.2% IDA merger. After thus violating the DPE orders thus, it cannot now say that the DPE order for granting stagnation increment once in two years is preventing it from accepting the proposal. Since it created the problem, and also since it agreed to settle the aberration, it is its responsibility to provide annual stagnation increments and thus solve the problem. 8. DoT allowed BSNL to issue orders increasing pay and pension, without any necessity for permission from it. Even if it feels such permission is required for it, it has to seek it and settle the issue, as per its commitment for settling aberrations. Since large number of employees is suffering due to stagnation thus creating unrest, it is requested to kindly take necessary action for approving this proposal and thus settle the problem. We shall be thankful for considering these submissions favorably, on urgent basis keeping in view the serious unrest in the staff on this issue.  Dear Comrades, BSNLEU’s upbeat CEC meeting held at New Delhi.
BSNL Employees Union conducted it’s upbeat Central Executive Committee meeting on 24th & 25th November, 2015, in Hotel Dakha International, Karol Bagh, New Delhi. The meeting hall was named in memory of com. A.M. Patil, former circle secretary of Gujarat. 28 circle secretaries and 22 central office-bearers participated in this meeting. Com. Balbir Singh, President, BSNLEU, presided over the meeting. Resolution on homage was moved by com. Swapan Chakraborty, Dy.GS and the house stood in silence for a minute and paid homage to the departed leaders. Com. K. Hemlata, National Secretary, CITU, inaugurated the CEC meeting. In her speech, com. Hemlata spoke at length on the success of the 2nd September, General Strike, the necessity to continue with the campaigning of the demands of the General Strike and on the pro-corporate and anti-worker policies of the NDA government. The report on activities was presented in the house by com. P. Abhimanyu, General Secretary. All the members of the CEC participated effectively in the debate, and enriched the report of the General Secretary. The 2nd September, General Strike, the ongoing efforts of the Forum to revive BSNL, status of the demands of the Non-Executive employees, victimisations in Kerala and Jamshedpur, invigorating the organisation, issues of the casual / contract workers and pensioners, etc. came in for serious debate. After in-depth discussions and the summing up by the General Secretary, the report was approved unanimously. Many important decisions were taken unanimously and also resolutions were passed on important issues. Inspiring seminar on the revival of BSNL. On the sidelines of the New Delhi CEC meeting, BSNL Employees Union organised an inspiring seminar on the evening of 24th November, 2015, in the Eastern Court. Apart from the CEC members, district secretaries of BSNLEU from Rajasthan, Haryana, Punjab, UP(West), UP(East) and NTR circle participated in the seminar. NTR circle union and the Corporate Office circle union had made excellent arrangements and decorations for the seminar. The seminar was presided over by com. Balbir Singh, President, and welcome address was delivered by com. Swapan Chakraborty, Dy.GS. Com. P. Abhimanyu, General Secretary delivered the key note address and kick-started the seminar. It was followed by the addresses of shri Anupam Shrivastava, CMD BSNL, shri N.K. Gupta, Director (CFA) and Ms. Sujata Ray, Director (HR). Com. R.S. Chauhan, CS, NTR & Organising Secretary (CHQ), proposed the vote of thanks. The seminar enthused all the participants, including the top officers of BSNL, and delivered a strong message that the revival of BSNL is not far off. Com. V.A.N. Namboodiri, Patron, felicitated. In the Kolkata All India Conference of BSNLEU, com. V.A.N. Namboodiri, relinquished from the post of All India Office-bearer. The Dalhousie CEC meeting which took place in June, 2015 had planned to felicitate com. V.A.N. Namboodiri, for his contributions and sacrifices to strengthen the trade union movement. However, that could not take place, due to the sudden demise of com. A.M. Patil. Hence, a felicitation programme took place on the first day evening of the CEC meeting. Senior circle secretaries, com. J. Sampath Rao, com. M.S. Kadian, com. C.K. Gundanna and also General Secretary, com. P. Abhimanyu, addressed the function and lauded the contributions of com. V.A.N. Namboodiri. Com. Animesh Mitra, Vice-President (CHQ), presented a memento to com. V.A.N. Namboodiri, on behalf of the CHQ. Com. Swapan Chakraborty, Dy.GS, honoured com. V.A.N. Namboodiri and offering a shawl. Decisions taken in the CEC meeting (1) The 2nd September General Strike has been successfully organised in most of the circles. The CEC meeting heartily congratulated all the BSNL employees who have participated in this historic strike. The meeting also congratulated all the circle and district unions for organising the strike effectively. Further, the meeting resolved to continue with the campaigning on Neo-Liberal Policies and also on the 12 point charter of demands of the Central Trade Unions. (2) The meeting noted with satisfaction, the improvements that have come in the financial condition of BSNL. It called upon the circle and district unions to actively coordinate with the other constituents of the Forum, for carrying out aggressive marketing and also in maintaining fault free networks, which will ultimately make the revival of BSNL possible. (3) The meeting came to the conclusion that the decision of the Cabinet to form a Subsidiary Tower Company is not in the interest of BSNL, since there is no guarantee that a private company would not be inducted as a strategic partner or that disinvestment would not be there in future. The meeting decided to resort to take all possible measures to oppose formation of the Subsidiary Tower Company. (4) After discussing the various options that have been suggested by the IIM – B, on the merger of BSNL and MTNL, the meeting decided that the issue should be further discussed in the Forum and also all steps should be taken to defend the interests of BSNL and it’s 2.25 lakh work force. (5) On the question of outsourcing of the provisioning and maintenance of wired line broadband connections, the meeting resolved that this would render a large number of Telecom Mechanics and TTAs surplus. It viewed with concern, the decision of the Corporate Management to go ahead with the outsourcing, without properly considering the alternative proposals given by BSNLEU to avoid outsourcing. The meeting called upon all the circle unions to seriously view this issue and to fully implement whatever call given by the CHQ to stop the reckless outsourcing of broadband activities. (6) On the victimisations of Kerala and Jamshedpur, the meeting expressed satisfaction with the action taken by the CHQ. The meeting further directed the CHQ to take all possible measures to settle the remaining victimisations within the shortest possible time. (7) On the issue of 30% superannuation benefits to the Directly Recruited Employees, the meeting expressed it’s deep concern over the inordinate delay in the settlement of the issue. The meeting urged upon the BSNL Management to expeditiously settle the demand of the Forum, of contributing 12% pay to the Pension Fund. (8) The meeting noted with satisfaction that as per the decision of the Dalhousie CEC meeting, Study Classes are being organised in December, 2015. The meeting urged upon all the circle and district unions to implement the decisions of the All India Centre, to make the classes successful. (9) The meeting once again underscored that Works Committee is an effective tool for improving the quality of service. Hence, the meeting urged upon the district unions to ensure the periodic conducting of the meetings of the Works Committees. The meeting also urged upon the CHQ to take steps for the early introduction of Works Committees at circle levels also. (10) The meeting noted with concern that, even after taking decision in the Dalhousie CEC meeting, circle council meetings have not taken place in Haryana, NTR and Jharkhand circles. The meeting urged upon the above mentioned circle unions to immediately ensure the conducting of circle council meetings. (11) The meeting noted with concern that, most of the circle unions have not sent their reports on the district wise particulars of the 2nd September General Strike, as called for by the CHQ. Similarly, most of the circle unions have not sent the district wise union membership details. The meeting urged upon all such circle unions, which have not sent the above two reports, to immediately send them. The meeting also urged upon all the circle secretaries to promptly send reports whenever called for by the CHQ. (12) As regards the anomalies that arose in the first wage revision, the Corporate Office has called for inputs from the CGMs. However, most of the CGMs have not sent the report, as a result of which this issue could not be processed by the Corporate Office. This meeting calls upon all the circle secretaries to take up the issue with their concerned CGMs and arrange to send the reports to the Corporate Office without further delay. (13) The meeting urged upon the CHQ to actively persue and settle the pending issues such as Stagnation, 30% superannuation benefits, Anomalies, 78.2% IDA merger to pensioners, PLI formula, Relaxation in qualifying marks for SC/ST employees, Designations, NEPP related problems, etc. etc. (14) The meeting called upon all the circle and district unions to observe the 125th Birth Anniversary of Dr. B.R. Ambedkar in a befitting manner, by holding seminars, special meetings, etc. Resolutions passed in the CEC meeting (i) On 2nd September, General Strike. (ii) On revival of BSNL. (iii) Against growing intolerance and for communal harmony. (iv) On settlement of pending issues. (v) On extension of 78.2% IDA merger to BSNL Pensioners. (vi) On improvement of BSNL Services. (vii) Against proposed privatitsation of NOFN work, by taking it away from the PSUs of BSNL, Power Grid and Railtel. (viii) On DA merger and Wage Negotiation. (ix) On allowing political rights to BSNL Employees. I request all the Circle Secretaries, Central Office-bearers and the District Secretaries to extend their fullest cooperation for the successful implementation of the decisions taken in the New Delhi Central Executive Committee meeting. BSNL reports operating profit of Rs.672 crore in 2014 - 15.
As per the statement of shri Anupam Shrivastava, CMD BSNL, published in various dailies today, BSNL has earned an operating profit (not net profit) of Rs.672 crore in 2014-15. Some other aspects of the statement: - 

  Income from services has increased by 4% to Rs.27,242 crore.
 Operating profit is Rs.672 crore. In 2013 -14, there was an operating loss of Rs.691 crore.
  Net loss increased to Rs.8,234 crore. Depreciation increased by Rs.2,000 crore.
 Administrative expenses have come down due to the retirement of 10,000 employees.
  Company will earn net profit in 2018 – 19.
 25,000 towers are installed in the last 2 years and the total number of towers at present is 1,00,000 towers.
 Rs.7,000 crore will be spent in the current financial year for network expansion.
  4G service will be started in a couple of cities by March end.
  At present there are 400 WiFi hotspots. It will be increased to 40,000.

[18.11.2015]7th Pay Commission to submit it’s recommendations tomorrow.

The 7th Pay Commission is submitting it’s report to the Finance Minister tomorrow. This is disclosed by the commission’s chairman, Justice A.K. Mathur. The recommendations will benefit 48 lakh Central Government employees and 55 lakh pensioner, and will be implemented with effect from 01.01.2016.

Today is the last day for filing your income tax return or ITR for the financial year 2014-15.
But even after filing your ITR online, your job won't still be over!
Here is a six-point checklist for taxpayers to be observed after e-filing of ITR online.
Most of us think that we are done away with our e-filing task as soon as we submit the ITR online. And perhaps this notion is one of the main causes for the troubles and income tax notices faced by taxpayers after e-filing.
For instance the taxpayers are supposed to verify their income tax return after e-filing and failing to do so may treat their e-filed ITR as invalid. Likewise, ignorance of other things may either lead to additional tax demand or loss of tax refunds.
1. Verify the ITR or dispatch ITR-V
The primary thing that one should do just after e-filing is that either s/he should e-verify her/his ITR or dispatch ITR-V to CPC Bangalore. The detailed manner of doing this is discussed below. Remember that you have to verify the ITR by any one of the following mode.
A. Electronic verification of ITR
The IT department has suggested two methods of verifying the ITR electronically. For electronic verification, you need to login to and navigate to 'E-Verify Return' option of the main menu.
i. The first method is through linking your Aadhar Card with your PAN number and thereafter generating OTP (one time password) which gets delivered at your registered mobile number and thereafter you will have to enter this OTP to validate your e-filing.
ii. The second method is through generating electronic verification code (EVC) which gets delivered at registered mobile number or email ID. This electronic verification code is then used to verify your ITR. The main drawback of the second method is that it cannot be used by those taxpayers who are seeking any ITR or if they have total income of more than Rs 5 lakh.
B. Dispatching ITR-V to CPC, Bangalore
If you have not verified your ITR electronically then you are supposed to send signed copy of ITR-V to CPC, Bangalore within 120 days of e-filing. ITR-V is the acknowledgement form that you get after filing your ITR. It must be signed and sent to CPC, Bengaluru within 120 days of e-filing your ITR. The address to send via ordinary post or Speed Post is:

It must not be sent by courier or other means. However, if you have signed the return by digital signature, then posting of ITR-V form to CPC, Bangalore is not required.
If you forget to e-verify your ITR or fail to dispatch ITR-V to CPC Bangalore then it will be considered as if you have not filed your income tax return and the IT department will not process your ITR.
2. Track the ITR-V receipt status
If you have opted to verify the ITR by sending signed copy of ITR-V then you must continuously track the receipt status of ITR-V at CPC, as you will get an alert for non-receipt of ITR-V due to postal loss. Once Central Processing Unit Bangalore receives your ITR-V form, it dispatches an email acknowledging the receipt of ITR-V which should reach you within a month of sending ITR-V to CPC Bangalore.
There are a number of ways to check whether CPC Bangalore received your ITR-V form or not. These are:
  • CPC Bangalore sends the email acknowledgment to e-mail ID which you have mentioned in your ITR. If you don't receive such mail then please check your SPAM folder.
  • You can also check whether CPC Bangalore received ITR-V form or not by entering PAN and assessment year or by filing the e-filing acknowledgment number on the ITR-V Receipt status tab under Services section of e-filing website.
  • It can also be checked by calling CPC Bangalore at 1800-4250-0025.
3. Track the intimation status
After e-verification of ITR, wait for around one month to get the intimation from IT department under section 143(1). You will receive another email from IT department once your income tax return gets processed. This email is called Intimation under section u/s 143(1). Intimation tells you the details about your total TDS deducted, total tax paid, and deductions, if any.
In intimation, you will also find information about any difference between the amount of income, deductions, income tax payable, TDS or income tax paid by in you in your tax return with respect to amount which income tax officer computed u/s 143(1). The same is reflected in the following 2 columns of intimation:
a. Income tax as provided by taxpayer in return of income
b. Income tax payable as computed by income tax office u/s 143(1)
Analysing intimation u/s 143 (1) is of great importance as it will tell you whether the IT department has accepted the details furnished by you in your income tax return as is or whether it differs in the tax calculations of income reported by you. In such a case, you may have to take corrective actions. Consequently you will also get to know whether you are entitled for any income tax refund or if you are liable to pay any more taxes.
4. Pay additional tax if the intimation specifies so:
If the Intimation Received u/s 143(1) specifies that the tax paid by you is less than what is computed by the IT department then this intimation becomes Notice of Demand u/s 156.
For example, if you have paid income tax of Rs 500,000 while the IT department computed your income tax as Rs 530,000 then it will be treated as fall of tax paid. In such case, if you feel that the IT department computation is correct then you can pay the short fall amount and if you think that there is a mistake then you will have to prove your case as per the necessary procedure.
5. Track income tax refund status
In case the income tax paid is more than what is computed by the IT department then the taxpayer is entitled for tax refund. From this year onwards, the refund will be directly deposited in the bank account mentioned in income tax return. The tax refund status can be checked by logging to the account at Alternatively the same can also be checked at, after the ITR gets processed.
6. Make sure to keep income tax records:
Even if you are done with filing of income tax return, it is very important to keep record of all the paper work safely as legal proceedings under the income tax act can be initiated within a span of six years and therefore keep all income tax related documents safely for at least seven years. Following records are advisable to be kept for future references.
  • Form 16, Form 12 B
  • Filed ITR along with ITR-V
  • Copy of Challan for tax paid
  • Tax deducted at source (TDS), Form 16A
  • Tax exemption documents
  • Bank account statements
  • Gifts deeds
  • Intimation from the IT department (soft copy email) and hardcopy etc.
