DoT to impose fine on infra companies
The Department of Telecommunications (DoT) will impose a fine of Rs 5 lakh on infrastructure firms if their base transceiver stations (BTS) had not received environmental clearance by November 15.
“All base transceiver stations, which have not been certified by November 15, 2010, or are not compliant, face a penalty of Rs five lakh each,” an official statement said here today.
BTS facilitates wireless communication between equipment and a mobile network. There are 560,000 BTS operational in the country, of which 416,000 systems have so far been self-certified for adherence to the standards prescribed by International Commission for Non-Ionising Radiation Protection (ICNIRP), the statement said.
DoT had extended the deadline for self-certificates to the Telecom Engineering and Resource Monitoring (TERM) Cells of DoT to November 15 from May 15.
“Even though there is no direct evidence of negative health-related implication of these radiations, the government is seized of the concerns raised in this regard and, as such, made self-certification a basic minimum requirement that telecom companies must adhere to,” Minister of State for Communications and IT Sachin Pilot said in the statement.
In another development, a study released by the industry bodies Cellular Operators Association of India and Association of Unified Telecom Service Providers of India said the radiation levels in Delhi are much below the international safety standards, putting to rest the growing public concern over emission of harmful radiation and related health hazards from mobile towers.
The study further said cumulative emissions from the cellular mobile towers are much below the prescribed limit set by the ICNIRP.

Com.S.Chandrasekharan passed away – our condolences

Com.S.Chandrasekharan, veteran leader of the P&T Trade union movement and former Asst. General Secretary of Administrative Union passed away yesterday at Chennai. He was at present working in CITU, Chennai. He was 80.

He was one of the leaders who was in the forefront fighting against the reformist policies of the NFPTE leadership. He was circle Secretary of both Administrative Offices Employees Union as also Line Staff Union, Chennai. He organised the Central Government employees movement there. Perhaps he and Com.A.K.Veeraraghavan might be the leaders who organised the Casual workers for the first time. For this and his other trade union activities, in 1977 he was compulsorily retired from service. But due to sustained efforts of the union he was reinstated. In 1979 he took voluntary retirement for full time trade union work and started working in CITU.

He was well studied and used to take regular trade union classes for the workers. He was always with the workers and for solving their problems. He was discussing a case with his advocate yesterday evening when all of a sudden there was serious heart attack and he succumbed to the same within minutes. He has got two daughters and one of them is working in BSNL.

Tarlochan Kaur, Avtar Singh Sahi, Rajiv Sharma and Atul Sharma have since joined BSNL Employees union with more than 100 members of NFTE-BSNL. The strike was very successful with the whole hearted participation of the Non-Executives and Executives. The 3 lakh workforce has told in one voice and with determination that the game plan of the government and other vested interests to weaken BSNL will not be tolerated any more.



Comrades, viability of BSNL was the main demand of our struggle. As all of us know that it is not a demand which can be settled in a single day. Rather, it is a continuous process to be persued with the government. Our strike has given out a strong massage to the government that BSNL workers and officers are very serious in restoring the viability of BSNL. Taking the message in right perspective, the new Secretary, DoT has assured his whole hearted support to strengthen BSNL. JAC will seriously pursue this issue through the Secretary, DoT. BSNL management has assured us that it would procure equipments for another 15 million lines, in addition to the 5.5 million lines for which tender is almost finalized. Representatives of BSNL's Employees Associationsfunions met with
Secretary (Telecom), DoT today where CMD, BSNL was also present. A follow-up .,
meeting with BSNL Management under the Chairmanship of CMD, BSNL was held
at 1500 hrs. on 2no December, 2010 in which Representatives ofJAC as well as from
the management side were also present.
In the cowse of meeting, the unions emphasized on the following issues -
r Procurement of GSM equipment
r Benefit of 50% IDA merger in pay fixation
The management side clarified that action is under way for procurement of 5.5
million lines to meet immediate demand,for North and East Zones. In addition, a
proposal is also being considered to procure l5 million lines for the next year.
On tle issue of Benefit of 50% IDA merger in pay fixatioh(effectively amounting
Io 78.2%), CMD BSNL informed that the case has been deliberated in the 130u
meeting ofthe Board held on 25.8.2010 wherein the Board taking into account all the
pros and cons decided to defer the implementation of the benefit of 50% of IDA
merger for pay fixation till the Company's financial position improves considerably
and there are visible signs of recovery. On further insistence by the JAC members,
CMD requested the union leaders to provide fresh inputs on this issue which could be
examined by the management before submitting the case to BSNL Board for its
consideration.
On the remaining issues, the position is given in Antexure-I.
With this, CMD BSNL again requested the JAC members to withdraw its ongoing
shike, to which the JAC members agreed.

30.11.2010: THREE DAYS STRIKE CALL - MAKE IT A GRAND SUCCESS - CMD BSNL called JAC Leaders & discussed about Three days strike & JAC demands. During discussion he mentioned that 78.2 % IDA fitment benefit issue has been discussed in the BSNL Board Meeting two months before but the BSNL Board advised to implement DPE Order only when BSNL starts earning profit and regarding procurement of GSM equipment he mentioned that 5.5 Million GSM lines tender is going to be finalised very soon because evaluation of Techno-commercial bids is completed and the evaluation of Financial Bids of this tender is in process. Regarding other issues i.e Refund of 18,500 Crores Spectrum Charges, 30% Disinvestment of BSNL, VRS to 1 Lakh Employees, Unbundeling of BSNL's last mile copper conductor, ITS Officers absorption, IDA Pension revision of BSNL Pensioners, Issuing instructions to all Govt. Departments /PSUs to take Telecom Services from BSNL, Reimbursement of license fee and USO charges etc. he mentioned that all these issues are under the consideration of DoT and he advised to meet DDG(SU) DoT to discuss further the status of all these issues.

CMD BSNL called JAC Leaders and discussed about Three days strike & JAC demands. During discussion he mentioned that 78.2 % IDA fitment benefit issue has to be decided by BSNL Board based on BSNL profitability. Regarding other issues, he advised to meet DDG(SU), DoT. After meeting the CMD, in view of the casual treatment of BSNL Management / DoT Administration, JAC decided to make three days strike call a Success . Strike call holds good.

Organise the 3 day strike effectively

The three day strike, called on by the JAC, is going to start from tomorrow, the 1st December, 2010. CHQ is receiving reports that in each and every Circle and District, meeting of the JAC is held and last minute preparations are being planned. The meeting held with the Regional Labour Commissioner yesterday, the 29.11.2010 has not yielded any result and it is only a formality. So far neither the Secretary DOT nor the ministers have called us for talks. This indifference has to be given a befitting reply. This is a “do” or “die” situation. Organise the strike effectively and make it a grand success. The strike will start from 0600 hrs on 01-12-2010 and will continue till 0600 hrs on 04-12-2010.

Mobile number portability (MNP) has long been awaited in India. Its implementation was postponed several times due to technical and bureaucratic glitches.

The service was originally scheduled for launch in December 2009, but the launch date was postponed to March 31 this year. Then it was again postponed to June 30, and thereafter to October 30.

The government clarified that it had taken the decision to delay MNP to October after evaluating whether access providers and long distance service providers were ready to implement the service, and in consideration of the complexity and enormity of testing involved before MNP is implemented.

MNP makes it possible for people to switch operators while maintaining their mobile number. For fear of losing their number, people often continued subscribing to a certain operator's services despite being dissatisfied with service.

The delay was caused by a variety of factors including policies and stakeholder preparation. Finally, though, MNP will now be available in Haryana starting today.


The countrywide launch of MNP will start from Rohtak district in Haryana. The service will be implemented across the country in a phased manner.

A subscriber who wants his mobile number ported (change service provider) will have to send an SMS to 1900 to obtain a 'unique porting code'. After getting the porting code, he will have to submit a duly filled porting form along with a customer acquisition form and a proof of identity to the service provider he wishes to shift. There will be a porting charge of Rs 19.


Upon completing the formalities, the customer will get the new operator's SIM card, and the new operator will inform him of when he can start using it, which should be within seven working days.

The subscriber can then start using his new SIM at the specified time.

A mobile number porting request can be withdrawn within 24 hours of having been made.

Conditions

For now, mobile number portability is limited to the Haryana circle.

Also, subscribers can switch their service provider only after 90 days either from the day when their existing number was activated, or from the time when they last ported their mobile number.

Before porting, all dues will have to be cleared if it is a post paid number. If it is a pre paid connection, any talk time that remains in it will lapse.

Human Resource Development Minister Kapil Sibal was on Monday given additional charge of the Telecom Ministry by Prime Minister Manmohan Singh in a development that takes the portfolio away from DMK – at least for the time being.



Official sources said Sibal will hold charge of the Ministry held by DMK's A Raja, who resigned on Sunday night facing allegations of irregularities in the 2-G spectrum allocation.



The arrangement is seen to be temporary in view of the ongoing Parliament session when issues related to the ministry are to be handled at the senior level, particularly at a time when the ministry is facing allegations of corruption of huge magnitude.



By tradition, a reshuffle of the Council of Ministers is not undertaken during a Parliament session.



Sibal, a renowned lawyer-turned-politician, was a week earlier given the additional charge of Ministries of Science and Technology and Earth Sciences, which fell vacant after incumbent Prithviraj Chavan was made chief minister of Maharashtra.




In another decision, V Narayansamy, Minister of State for Parliamentary Affairs, was given additional charge of the Department of Personnel and Training (DoPT), which also fell vacant after Chavan's departure.



Commenting on the additional charge given to him, Kapil Sibal said any ministry when given is a challenge and decisions should be taken after proper thinking.



Reacting to the Prime Minister's move, DMK Parliamentary Party leader T R Baalu said party chief M Karunanidhi has not yet decided on a successor to A Raja and suggested that Sibal getting Telecom as additional charge could be a "stop-gap arrangement".

Vested interests are vociferously trying to make a propaganda that employees do not get benefit from the Non-Executive Promotion Policy (NEPP) and that it is a useless scheme. But, in whichever SSA it is implemented, it is seen that a large number of employees are benefited. For example, Dharmapuri is a small SSA in Tamil Nadu Circle. The total number of Non-Executive employees in this SSA are only 425. Out of this, 318 employees have got promotion under the NEPP. It means 75% of the Non-Executives in this SSA are benefited. All to make note please:- A March to the Parliament programme is being organised by the Joint Action Committee on 15th November, 2010, as a part of the ongoing save BSNL campaign. BSNLEU is trying to make the programme a resounding success. As already intimated through the CHQ circular etc., all the circle unions have been requested to make maximum mobilization for the programme. CHQ has especially asked the circles adjoining Delhi, like NTR, UP(West), Haryana, Rajasthan and Punjab to make the fullest mobilization. Only a few days are left for the rally. [15.10.2010]Successful one day hunger strike by General Secretaries

As per the decision of the JAC the General Secretaries went on a one day hunger strike today, the 15.10.2010, at the Corporate Office, New Delhi, demanding immediate payment of bonus to the Non-Executives and Executives of BSNL. Most of the General Secretaries and the Convenor of the JAC participated in the hunger strike. The programme is very successful. On behalf of the management, shri R.K. Agarwal, Director (Planning) invited the fasting leaders for discussion. After detailed discussion, the Director (Planning) assured that our demand for payment of bonus would be strongly taken up in the next Board meeting. Inspite of the assurance given by the management, the leaders continued their fast till the evening.



[15.10.2010]Date of Dharna changed to 28.10.2010

The JAC had earlier given call to conduct Nation Wide dharna on 19.10.2010. However, it came to the notice of the JAC leaders that Shri Gopal Das, CMD BSNL had gone on a foreign tour and would be returning to the Delhi only around 23.10.2010. In view of this development the JAC, in its meeting held today, decided to change the date of the dharna to 28.10.2010, since there is no use in holding the dharna when the CMD has gone on foreign tour.

In the JAC meeting held yesterday, the 12.10.2010, it was decided to take up the bonus issue with CMD BSNL. It was decided to immediately meet the CMD and discuss the issue. Accordingly, the leaders of the JAC met the CMD and strongly argued for bonus payment to all the Non-Executives and Executives immediately. However, CMD rejected the demand. Thereafter, JAC again met and took the following decision for agitational programme.

[13.10.2010]JAC finalises strike notice – Dates of strike and March to Parliament changed



The JAC meeting took place yesterday the 12.10.2010, at New Delhi. In the meeting, the demands to be incorporated in the 3 day strike notice were finalized. The JAC has made a change in the dates of the 3 day strike. This was necessitated due to the fact that the counting of votes for Bihar assembly elections is to take place on 24.10.2010. Similarly, the date for “March to the Parliament” is also changed in view of the fact that the US President is visiting Delhi and will be addressing the Indian Parliament. Now, the final dates of the strike and “March to Parliament” will be as follows.

[08.10.2010]Bonus – Discussion with CMD



Com. P. Abhimanyu, GS and Com. Swapan Chakraborty, AGS met Shri Gopal Das, CMD, BSNL today and insisted that Bonus should be paid to the employees before Pooja. CMD, BSNL told that it is not possible to pay bonus this year, in view of the fact that company has gone into loss and also there is no cash reserve with the company. Union Representatives explained him how bonus payment is justified and strongly demanded to make early payment of bonus. In view of the negative attitude of the management, BSNLEU together with United Forum, will decide for appropriate action.





[07.10.2010]Condolence: - Veteran leader of P&T trade union movement Com. Swadesh Ranjan Das breathed his last on 07th October, 2010. He was one among the leaders, who lead the glorious 5 days strike of CG employees in 1960. He was elected as Federal Council member in 1991 Bhopal conference of E-III. He was the founder President of Contract workers union in BSNL, Kolkata Telephones. CHQ express its deep grief and convey its heartfelt condolences to the bereaved family, members and comrades.

Our union representatives met the Executive Director (Finance) today and insisted upon him to take decision on payment of Bonus issue, since the festival season is fast approaching. Our representatives have insisted that bonus should be paid to the employees, despite the fact that the company has incurred loss in the last financial year.

[05.10.2010]NFTE BSNL files case in Madras High Court against 5th Verification The process for 5th Membership Verification has been started by BSNL Management. Applications are called for from unions for participation in the verification. The last date for submitting application is 31.10.2010. However, NFTE BSNL has filed a writ petition in the Madras High Court. It has sought for an interim injunction against conducting the 5th Membership Verification. It also wants the framing of a new set of Code of Discipline, to ensure more than one trade union to be recognized. BSNL Employees Union is also made a party in this case. Those who are unable to face the workers in the 5th verification are trying to create legal hurdles. We will face the challenge squarely.

[30.09.2010]Pension Revision of Pre-2007 BSNL retirees





Shri S.C. Misra, Member (Services), Telecom Commission while inaugurating the Seminar in connection with the Extended CEC meeting of BSNLEU at Nagpur on 29th October 2010, informed that all the concerned departments viz. Department of Pension & Pension Grievances, Department of Law, Department of Expenditure and lastly Department of Public Enterprises have returned notes approving the revision of pension of BSNL pre-2007 retirees. Now the file will be submitted to the Minister Communications & IT. After approval by MoC, the Cabinet note will be submitted to government for approval. BSNLEU is persuing the case vigorously for early orders.





[25.09.2010]West Bengal Circle Union has sent an amount of Rs.9,07,600 as donation towards CHQ building fund. With this remittance, the total amount donated by West Bengal Circle comes to Rs.9,67,600. CHQ congratulates West Bengal Circle Union and all our members in that circle.





[24.09.2010]Strike dates rescheduled! Organise march to Parliament!!



The National JAC which met on 23-09-2010, at New Delhi, reviewed the preparations for the strike which is to take place on 19th to 21st October, 2010. As per the reports received, the conventions conducted in various circles have evoked great enthusiasm among the employees. However, due to the assembly elections in Bihar and Local Body elections in Kerala, a demand has come from those circles to reschedule the strike dates. Considering the importance of the elections, the JAC decided to reschedule the strike dates. Accordingly the strike will now take place on 24th, 25th and 26th November. Further, the JAC has also decided to conduct a march to the parliament on 11th November, 2010. Circle, District and Branch secretaries are requested to make note of the changes and act accordingly. Fullest mobilization may be started both for the march to the Parliament and for the strike in November.





[23.09.2010]Kerala shows the way



Kerla Circle has sent an amount of Rs.20,00,000 towards building fund. With this, the total amount remitted by Kerala Circle Union comes to Rs.20,00,000. This is the biggest amount remitted by any circle union so far, towards building fund. [18.09.2010]5th Membership Verification – Some feel helpless and frustrated

The time schedule for 5th membership verification has just been finalized. However, by this time some have already started feeling helpless and frustrated. Out of frustration they have started abusing us and the stand that we took in the all union meeting held on 16.09.2010.



In the all union meeting, held on 16.09.2010 with the management, some unions demanded that the Code of Discipline should be given up and BSNL should frame it’s own Recognition Rules. As far as we are concerned, we cannot take a decision on such a serious issue, without consulting our Circle Secretaries and CHQ office-bearers. So, we informed the management that we could convey our decision on this issue, only after discussion in our Central Executing Committee which is going to meet from 27th to 29th September, at Nagpur. Management said that they could not wait till such time and announced that the 5th membership verification would take place on the basis of Code of Discipline.



Some unions opposed this decision of the management and walked out of the meeting, declaring that they would boycott the 5th verification, if it is conducted on the basis of code of discipline.



As far as we are concerned, we have confidence on the workers. We are ready to face the election either based on the code of discipline or based on the Recognition Rule to be framed by the management. All that we want is some time to take a democratic decision at the appropriate forum. But some don’t have confidence on workers. They require the mercy of the management to run their show. When they did not get help from the management, they have become frustrated and abuse us. We can’t help them.



[17.09.2010]Supreme Court issues notices on 2G Spectrum scandal

On the Multi Crore Spectrum scandal, the Supreme Court has issued notices to the CBI, the Telecom Minister, Income Tax Department and the Enforcement Directorate. The notices were issued, based on a Public Interest Litigation, filed by an NGO. The petitioner has alleged that the DoT had given away 2G Spectrum to 122 operators, at a throwaway price of Rs.1,658 crore for a pan-India license on a first-come-first-served basis, in January, 2008. The court has directed that the reply should be given within 10 days.

[17.09.2010]Revision of Pension

The issue of revision of pension of Pre-2007 BSNL retirees was discussed with Shri S.C. Misra, Member (Services), Telecom Commission on 16.09.2010. He informed that he has already reminded Secretary, DPE regarding the issue. Once the file is received back, after approval by the Communications Minister, the cabinet note will be forwarded to government for approval.

[16.09.2010]All union meeting with BSNL management on 5th Membership Verification

BSNL management had called for an all union meeting to discuss about the 5th Membership Verification. The meeting took place today (16.09.2010). Com. V.A.N. Namboodiri, President and Com. P. Abhimanyu, GS, represented BSNLEU in the meeting.



In the meeting, some unions proposed that BSNL should give up the Code of Discipline and should frame it’s own “Recognition Rules”, based on which the 5th verification should take place. BSNLEU took the position that introducing of BSNL’s own Recognition Rules was a serious matter and that the same could not be accepted without discussing it in the Central Executive Committee of the union.



Thereafter, management announced that 5th verification would be held on the basis of Code of Discipline only. Protesting this, some unions like NFTE, FNTO etc., walked out of the meeting. They also declared that they would be boycotting the 5th verification, if it is conducted based on the Code of Discipline. However, the meeting continued and the time schedule for conducting 5th verification was finalized. The following is the time schedule for 5th Membership Verification.

[14.09.2010]Delay in the implementation of NEPP- Circle and District Secretaries to note please.

It is learnt that the process of implementation of the Non Executive Promotion Policy (NEPP) has not at all started in many districts. It seems that there is a wrong understanding at the field level that this process can be started only after the expiry of the last date for giving options, i.e., 22-10-2010.If the process starts only after 22-10-2010,then there will be great delay in giving promotions to the officials. This is undesirable. At the intervention of the CHQ, BSNL CO has already issued order to implement the NEPP at the earliest. (Lr.no.27-7/2008-TE dated 06-09-2010) Hence, Circle and District Secretaries are requested to ensure that all officials give their options immediately and also to ensure holding of DPC etc. without further delay.

[10.09.2010]Meeting held on 09-09-2010 by Member (Services), DOT with Joint Action Committee of Unions / Asssociations of BSNL Non – Executives / Executives on Sam Pitroda Committee Recommendations.



Shri S.C . Misra, Member (Services) DOT and the Chairman of the Committee appointed by the Telecom Commission to examine and give its recommendations on implementation of the Sam pitroda committee Report on BSNL, held a meeting with the JAC of BSNL Unions/Associations on 09-09-2010 at 15-00hrs, in Sanchar Bhawan.



The JAC submitted its views on the recommendations of Sam Pitroda committee. Discussion took place on the points submitted by JAC. The JAC strongly opposed disinvestment, VRS/Transfer of one lakh employees, unbundling, formation of subsidiary for cell towers, formation of subsidiary for developing vacant land of BSNL in collaboration with a Real Estate company etc. . The JAC told Shri. S.C. Misra that BSNL should be not only considered as a commercial organisation but also as a PSU having social responsibility and as an instrument in the hands of the Government to fulfill its social obligations. The JAC demanded that the Government should suitably compensate BSNL financially, for incurring losses while fulfilling social obligations.



Shri. S.C. Misra told that the meeting helped him in understanding the view point of workers. He further asked the JAC to submit additional note on issues like reimbursement to BSNL for fulfilling social obligations, business plan to utilise the local copper cable in best possible manner in case unbundling is not wanted, etc.



However, we should prepare for serious struggle in order to defeat the anti BSNL policies of the Government. We should make the JAC call for 3 days strike from 19-10-2010 to 21-10-2010 a grand success, in order to protect BSNL and our future.



Com. VAN Namboodiri ( Convenor JAC & President BSNLEU) and Com. P.Asokababu ( Dy. General Secretary BSNLEU) represented BSNLEU in this meeting. Com. P. Abhimanyu General Secretary, BSNLEU was out of station to attend the Circle Conference of Andaman & Nicobar circle.

[09.09.2010]Pension Revision – Leaders met DOT officers:- Com. VAN Namboodiri (President BSNLEU & Adviser AIBDPA ), K.G. Jayaraj ( General Secretary, AIBDPA) and P. Asokababu ( Dy. General Secretary BSNLEU ) today met concerned officers of DOT and pressed for early settlement of pension revision of pre 2007 BSNL retirees. Shri. S.C. Misra Member (Services) has stated that the cabinet note sent to the four ministries simultaneously has been received back except from DPE. Once the note from DPE also is returned back, this note will be compiled with suggestion if any from other ministries first submitted to hon’ble minister for Communication & IT and there after to the cabinet for approval.

Constituents of the JAC presented their views on the recommendations of the Sam Pitroda Committee, to the BSNL management, on 06.09.2010. The unions and Associations affiliated to the JAC opposed tooth and nail, disinvestment including sale of 30% share to a strategic partner, reduction of one lakh staff strength through VRS and unbundling of BSNL’s copper cable. BSNL management assured to convey the views of the JAC to the DoT. The JAC is also meeting the DoT on 09.09.2010 and will be presenting it’s views on the recommendations of the Sam Pitroda Committee.
