Online shopping during work good for workers

Bangalore: Employees spending time shopping online at work can be frustrating for employers, but an expert suggests that a little time out from work might not affect workers' performances as believed by bosses.

"When you spend over 40 hours a week at work, it's no surprise that employees turn to their office computers to get some holiday shopping done," said Dr. Claire Simmers, Co-author of the study. She believes that instead of focusing on workers shopping on the company's dime, employers should turn their attention to performance outcomes.


"We've got to get away from basing performance on those eight hours," said Claire. "If an employee spends an hour surfing the net, but an entire weekend working on a report, there should be trust that both are equally benefiting from this relationship," she added.

Claire said that all employers need to accept that their workforce might also use their personal cell phones or other devices to shop for gifts. "With mobile technology, it's a whole new ballgame," she said. Instead of holiday shopping on the company computer, many employees will use their personal technology to shop for gifts. For an employer to police that kind of activity is nearly impossible, she added.

The Trade Union Advisory Committee (TUAC) to the OECD is an interface for trade unions with the OECD. It is an international trade union organisation which has consultative status with the OECD and its various committees.

TUAC's origins go back to 1948 when it was founded as a trade union advisory committee for the European Recovery Programme - the Marshall Plan. When the OECD was created in its current form in 1962 as an intergovernmental policy making body, TUAC continued its work of representing organised labour's views to the new organisation. The OECD is now changing again, taking in new members and becoming a leading forum for intergovernmental policy making to manage globalisation. TUAC's role is to help ensure that global markets are balanced by an effective social dimension. Through regular consultations with various OECD committees, the secretariat, and member governments TUAC coordinates and represents the views of the trade union movement in the industrialized countries. It is also responsible for coordinating the trade union input to the annual G8 economic summits and employment conferences.

TUAC's affiliates consist of over 58 national trade union centres in the 30 OECD industrialised countries which together represent some 66 million workers. It is they who finance TUAC activities decide priorities and policy and elect the TUAC officers.

The large majority of TUAC affiliates' are also affiliated to the International Trade Union Confederation (ITUC). Most European affiliates also belong to the European Trade Union Confederation (ETUC). TUAC therefore works closely with these international trade union organisations as well as with the International Labour Organisation (ILO). TUAC also works closely with Global Union Federations to ensure effective trade union input to OECD sectoral work such as education, public sector management, steel, or maritime transport. TUAC with the ITUC and GUFs are members of the Council of Global Unions.

TUAC operates through a small secretariat, based in Paris, of 5 policy staff and 3 administrative staff. John Evans is the General Secretary of TUAC.

TUAC's day to day work involves meeting with the OECD Secretariat, Committees and Member governments to appraise them of the views of the trade union movement on the issues on the OECD's agenda.

At the same time TUAC briefs affiliates on a regular basis on the work under way in the OECD, coordinates policy statements on major areas of interest and evaluates the outcome of OECD meetings and publications. The TUAC secretariat are frequently called on to make presentations to meetings or Congresses of affiliates and other international trade union organisations. This process enables the trade union movement to have access to the intergovernmental policy debate and at the same time allows policy makers to have dialogue with the Social Partners. Given the growing impact of globalisation on working people and their families and the realisation of the need for participatory strategies by governments for all the stakeholders in market based economies, this dialogue is more important than ever.

The formal decision making body within TUAC is the Plenary Session, which meets twice a year (April/May and November/December). All TUAC affiliates and the representatives of the international trade union organisations are invited to attend, and normally around fifty union Presidents or General Secretaries, International Secretaries and Economic or Research heads attend. The Plenary Session discusses and approves major policy statements, discusses the work programme and priorities, it also sets a budget and affiliation fees and elects TUAC Officers.

The Plenary also elects an Administrative Committee which is in charge of overseeing the administration of TUAC. At the moment it consists of the following organisations: DGB, Germany; CLC, Canada; TUC, United Kingdom; AFL-CIO, United States; FO and CFDT, France; CGIL, Italy; RENGO, Japan; ÖGB, Austria; TCO, Sweden and CSC, Belgium together with the President, the Vice-Presidents and the General Secretary.

The Officers are elected for four year renewable terms. Currently the President of TUAC is John Sweeney, President of the AFL-CIO (USA). The Vice-Presidents are Luc Cortebeeck, President of the Belgian Confederation of Christian Trade Unions (CSC-Belgium),Tsuyoshi Takagi,President of RENGO Japan, and Marie-Louise Knuppert, Secretary of LO-Denmark. The General Secretary is John Evans.

In addition to the General Secretary the TUAC Secretariat consists of Policy Advisors (Kirsty Drew, Pierre Habbard, Anabella Rosemberg & Roland Schneider), an Administrative and Financial Assistant (Michelle Vedel), and two Secretaries (Pierre Benielli and Brigitte Pomel).

Working Groups exist on Economic Policy, on Global Trade and Investment, and on Education, Training and Labour Market Policy. The Working Groups prepare TUAC positions for both the Plenary Session and for consultations with the OECD. They are open to all affiliates, the international organisations and TUAC "partner" organisations in Central and Eastern Europe. In addition a range of ad hoc meetings are held under specific areas being considered by the OECD.

TUAC normally has consultations with the Bureaux of OECD Ministerial meetings where statements are submitted. Trade union presentations are also made to the OECD in the course of consultations with different OECD Committees. There is also an annual meeting with the OECD Liaison Committee for Non-Governmental Organisations, which is made up of members of the OECD Council. TUAC representatives now also participate in some OECD Committees or Working Groups as active observers. On average some four hundred trade union representatives take part each year in different TUAC and OECD meetings mostly at OECD headquarters in Paris.

There is also an OECD Labour/Management Programme, partially financed by the OECD, which serves as a forum for preconsultations between trade union and management experts on matters that eventually come up in the OECD's programme of work.

TUAC also organises on a regular basis conferences with affiliates and other trade union bodies in OECD countries reports are usually presented as publications.

[26.11.2009]Meeting of the Wage Negotiation Committee is held today. Discussions continued on the construction of new pay scales, including the span. Staff side strongly argued that the conversion factor should be at least 2, whereas the management side was not prepared to accept anything more than 1.91.After discussion, management side said that they wanted some more time for their internal discussion. Hence, today's meeting ended without taking any decision. Next meeting will take place on 04-12-2009. In that meeting along with payscales, revision of perks and allowances will also be discussed.

[26.11.2009] Meeting of the Wage Negotiation Committee is held today.Discussions continued on the construction of new pay scales,including the span.Staff side strongly argued that the conversion factor should be atleast 2, whereas the management side was not prepared to accept anything more than 1.91.After discussion, management side said that they wanted some more time for their internall discussion.Hence, today's meeting ended without taking any decision.Next meeting will take place on 04-12-2009.In that meeting alongwith payscales,revision of perks and allowances will also be discussed.

HC rejects govt plea on advancing date for spectrum

The Delhi High Court today rejected a petition by the government challenging an earlier order quashing a notification for advancing the cut off date for release of 2G spectrum to telecom operators.

The Telecom Ministry, headed by A Raja, had advanced the date by a week to September 25, 2007 for issuance of licence, a decision that was challenged by Chennai based operator S Tel.

After losing the case at the single member Bench, the government had moved a Division Bench seeking quashing of the order, which in other words would mean that Telecom Ministry would have to consider applications received till September 31 received for 2G spectrum.

A Division Bench comprising Chief Justice A P Shah and Justice S Muralidhar dismissed DoT's petition seeking stay over the order of the single member Bench of July 1, 2009.

The court did not agree with DoT's submission that it had advanced the date to handle the large number of applicants and it was a 'public policy' decision.

The Division Bench upheld Justice G S Sistani order, who held that DoT could not "arbitrarily fix a cut off date for capping the number for licences bundled startup spectrum" and quashed the press note issued on October 10, 2008.

"The respondent (DoT) has failed to satisfy the court as to how any public interest would be affected in the matter. The impugned press release dated October 10, 2008 is quashed," Justice Sistani said directing DoT to consider Chennai-based S Tel's application to start operations in 16 circles.

Earlier, the deadline was October 1, 2007. However, in January 2008, the DoT had amended the criteria and said that due to a large number of applications, only requests up to September 25, 2007, would be considered.

The court's direction had come on a petition filed by Chennai-based S Tel, whose application for licence in 16 circles was turned down as it had applied on September 28, 2007, three days after the cut-off date.

EXPLANATORY NOTE



While devising the Pay scales, the changes made in Central Government Employees Pay scales by the 6th CPC has been taken into account. The following changes have been made in the 6th CPC.

1) There will be no Group D Pay scales. All the Group D scales have been upgraded to the level of 2750 ( CDA scale) and a minimum of Rs.7000/- recommended.

2) The scale of pay of Postman has been upgraded from 3050 to 3200-4900. Whenever the pay scale of Postman is revised it is customary that the Pay scale of Lineman and Telegraph man also to be revised from the same date. Hence, the pay scale of Pay of 3050-4590 has to be upgraded to Rs.3200-4900 and accordingly the higher scale is proposed for this category of employees in BSNL.

3) If the Pay scale of LM/T Man, etc., is revised it is natural that the Pay scale of Telecom Mechanic also be upgraded to the level of 4000-6000(CDA) as it is the promotional grade to LM, T Man, etc. Accordingly, the Pay scale of 3200-4900 be upgraded to 4000-6000 and IDA scale proposed.

4) The Pay scale of Senior TOAs also needs to be upgraded as it is a long pending demand and Group of Ministers have also recommended for higher pay scale to the cadre.

5) The CDA scale of 5000-8000 & 5500-9000, i.e., OTBP/BCR scales have been merged and upgraded to the level of 6500-10500 and the 6th CPC recommended higher pay scales. We have also therefore merged these two scales and proposed the single IDA scale as the new promotion scheme will replace the OTBP/BCR scheme, when implemented.

6) Similarly, the 6th CPC has upgraded the Pay scale of HSG I, which is equivelant to Grade IV, i.e., 6500-10500 to the level of 7450-11500.We have proposed a higher scale talking into account the above change.

7) While fixing the minimum Pay, the ratio between minimum and maximum scale of lower paid Group D and the Chief Executive, prescribed in the First and Second wage Review Committee has taken into account.

Major Achievement on Wage Revision


In the meeting of wage negotiation held today, 17th November 2009, the following understanding has been reached:

1. 30% fitment on pay + 68.8% IDA

2. No periodicity will be mentioned. Next wage revision for non-executives will be along with executives.

3. Increase of fitment on 68.8% to 78.2% IDA both for non-executives and executives simultaneously.

4. 3% annual increment

A great start has been made. The next meeting of the committee will be held on 19th November to discuss pay scales and other issues.

Re-tender 93-million line order, DoT asks BSNL

Process already stuck for a year on Chinese bidder concerns.

The Department of Telecommunications (DoT) has suggested a quick re-tendering of the 93-million GSM line order, one of the largest single contracts in the world, from Bharat Sanchar Nigam Ltd (BSNL).

This is to ensure more than one bidder in each zone, which would ensure the cheapest price for equipment. DoT, in a letter, has asked for BSNL’s comments on the issue.

DoT has said it is possible to re-tender in a short duration and complete the procurement process in two to three months, as tender documents have already been prepared and all bidders are fully familiar with these.

The move, if accepted, could put BSNL at a further disadvantage in catching up with its competitors who have been expanding their capacity, as a result of which the state-owned corporation is losing market share in the mobile space. The equipment order has already been delayed for nearly a year, due to security issues raised about Chinese manufacturers.

In its communication to BSNL, the department had said there was no competition in any zone (the tender order was divided into north, east, south and west zones) and no bidder was left in the west zone. Under these circumstances, though equipment costs are coming down, negotiations with a single bidder may result in finalisation of tenders at higher rates. Besides negotiations with a single bidder will lack transparency in decision making.

When asked to respond for this report, BSNL officials declined to comment. Currently, BSNL is already involved in price negotiations with Ericsson for the two zones and for the southern zone with Huawei. It has also given advance purchase orders to both.

The problem arose after the government decided not to allow Chinese companies to supply equipment in telecom circles that have a border with Pakistan, Nepal, Bangladesh or Myanmar and are considerd sensitive by India. As a result, Chinese manufacturer, Huawei, the highest bidder in west India, was not given the contract, as it was considered a sensitive area.

The same logic ensured that Huawei, the second highest bidder in the north and the east, would not be considered there at all, leaving only Ericsson in the ring. In the south, while Huawei was the highest bidder, the bid of Nokia Siemens was rejected on some grounds, as a result of which the company went to court.
