NEW DELHI: BSNL has overcome two major challenges in its attempt to award the world’s largest telecom contract, clearing the way for it to open price negotiations with the two companies it has shortlisted for the deal.

An ‘integrity panel’ set up with the permission of the country’s top anti-corruption body, the Central Vigilance Commission, has endorsed the state-run company’s decision to disqualify, on technical grounds, Nokia Siemens Networks from its Rs 35,000-crore tender to supply equipment for 93 million mobile phone connections.

The Andhra Pradesh High Court, too, ruled on Monday that BSNL was justified in disqualifying NSN because it did not meet the technical requirements.

“We are glad both the integrity panel as well as the courts have cleared us of any wrong doing given the fact that there were allegations that we were not transparent with the selection process,” a top BSNL executive said.
BSNL, the executive added, will immediately start price negotiations with China’s Huawei and Swedish company Ericsson. “The only possibility of this tender being further delayed is if NSN were to approach the Supreme Court.”

BSNL has been making huge operating losses in the past two years, only managing to stay in the black because of interest income from its accumulated cash reserves. It ran out of capacity to expand cellular services nearly 18 months ago and no new major contracts for mobile networks and equipment have been awarded in the past 24 months.

NSN said it has obtained the report of the integrity panel — whose members are former chief election commissioners TS Krishnamurthy and BB Tandon — and is “internally reviewing the contents.” A company official added that it has still not received the order of the AP High Court.

The panel was set up after NSN approached the anti-corruption body seeking a probe into its disqualification. It also filed petitions in the Delhi and Chandigarh High Courts as well as the AP High Court. While the Delhi High Court said the case did not fall under its jurisdiction, the Chandigarh High Court asked BSNL to get NSN’s bid evaluated by an independent panel. The AP High Court had in May asked BSNL to put on hold the tendering process until it took a decision.

In May, a year after the tender was floated, Ericsson was short-listed as the lowest bidder for the northern and eastern regions, while Huawei made the cut for the western, eastern and southern zones. NSN has argued before the courts that it was not given proper reasons for its disqualification and claimed all details that BSNL wanted were provided.

On the other hand, BSNL has maintained that all the four companies which were disqualified — NSN, China’s ZTE, Alcatel-Lucent and Nortel — were purely because of technical reasons.

BSNL executives have told ET that they suspect ‘vested interests’ are behind the legal challenges to delay its tender and stymie the state-run company’s expansion. They cited a similar petition in Delhi High Court in 2006 by Motorola, which delayed BSNL’s expansion plans by about a year. Motorola later withdrew the case. BSNL’s last tender in 2006 for about 43 million lines, then the largest, was finally reduced to 13 million lines after telecoms minister A Raja’s intervention.

The umbrella body representing all employee unions of BSNL has asked the telco’s management to act against NSN for delaying BSNL’s expansion plans.

NSN denies any such motive and says it has “long-standing relationship with BSNL” and “look(s) forward to supporting them in the future as well”.

NFTE and FNTO are the partners of the so called “BSNL workers Alliance”. These two unions claim that they have the support of 50% of the BSNL workers (Let them have the pleasure of claiming so). These unions have refused to come forward for a joint struggle with the United Forum on the question of wage revision for obvious reasons. Every now and then they do not fail to make shows that they are also fighting to settle wage revision. Today, the main problem in the settlement of wage revision is the ‘period’. The United Forum alliance, of which BSNLEU is a constituent, is demanding a 5 year settlement. The United Forum has already conducted a glorious two days strike on this demand. Whereas, the management wants to impose a 10 year settlement. But what is the stand of the BSNL Workers Alliance on this crucial issue.

FNTO has openly accepted management’s condition of a 10 year wage settlement. In fact, it is aggressively campaigning for the same. FNTO has also written to the management, that it was prepared to accept a 10 year wage settlement. In collusion with the management, FNTO has called upon the workers, to submit declarations, stating that they were ready to accept a 10 year wage settlement. This unethical step of FNTO has been overwhelmingly rejected by the workers. Hence, out of frustration, FNTO is conducting a vilifying campaign against BSNLEU. It has branded BSNLEU’s demand of a 5 year wage settlement as political. Workers have understood the true colour of FNTO and have ignored it’s vicious propaganda.

Under these circumstances, it is not known what is the stand of NFTE on this vital question of periodicity. NFTE is a constituent of the CPSTU. As such it is duty bound to the demand 5 year wage settlement and strive to settle it. But fact remains that, it is not openly raising this demand. When it’s alliance partner, viz., FNTO, is openly and vociferously campaigning for a 10 year wage settlement, NFTE prefers to remain silent. What does this mean? Has NFTE deviated from the decision of the CPSTU to demand a 5 year wage revision? It has to make it’s position clear.

Further, what is the demand of the BSNL Workers Alliance on the question of periodicity? The two major partners have identical view on periodicity or not? If so, what is that view? Five years or 10 years. The Alliance has the duty to spell out it’s stand to the workers.


His Master’s Voice

FNTO argues that BSNL cannot afford to accept a 5 year wage settlement, since it’s performance and profit have gone down. This is precisely the argument of the management also. We have a few questions to ask. Only a few months back, the top executives of BSNL have got pay hike upto 72%. How the performance and profit of the company permitted that? A little earlier, the entire ITS officers got hefty pay hike, as per the recommendations of the 6th pay commission. How BSNL’s performance and profit parameters permitted that? How is that only when the workers raise a justified demand, BSNL’s performance and profit are not permitting it? The workers have understood that the voice of FNTO is nothing but the voice of the management.

Miss Venezuela Stefania Fernandez has been crowned as the new Miss Universe. The pageant kicked off in Bahamas early on Monday morning. The girls were judged according to three categories - swimsuit, evening gown and interview. The pageant was hosted by Access Hollywood co-anchor Billy Bush and model, actress and former Miss Rhode Island USA Claudia Jordan. The contest has been watched in over 180 countries. Three beauties from Latin America were among the top five finalists chosen to vie for the Miss Universe crown. The five finalists were from Puerto Rico, Dominican Republic, Kosovo, Australia and Venezuela.Stefania will be crowned by the reigning Miss Universe Dayana Mendoza of Venezuela.

The Historic Strike by BSNL Workers

The 48 hours strike on 19-20 August, 2009, by more than two lakh non-executive workers in BSNL, demanding early wage revision, Promotion Policy, wage settlement for Casual & Contract Workers, full pensionary benefits for BSNL retirees etc. was a magnificent success. It gave shock waves to the management, whose adamant, unreasonable and unjustified stand was the main reason that compelled the workers to resort to the strike.

Discrimination against Non-executives

BSNL is one of the biggest PSUs in the country with about 3 lakh employees including officers. There are about one lakh casual and contract workers engaged by the company since no major recruitment has taken place for the last 20 years due to ban on recruitment. The top level management at Corporate office and Circles (States) are occupied by about 1500 ITS officers, who are still not absorbed in BSNL even after 8 years, but are on deputation and getting both the benefits of government service and PSU salary. Their pay revision w.e.f. 01.01.2006 have already been effected one year back and huge arrears drawn. The minimum salary of CMD was raised from Rs. 27,750 to Rs. 80,000 and maximum from Rs. 31,150 to 1,25,0000. Similar increase has been given to Chief General Managers, etc. The pay revision of about 60,000 executives of the middle level management is also effected w.e.f. 01.01.2007, more than 6 months back and arrears also drawn and paid.

In the case of non-executive workers, who number about two and half lakhs, the management has been taking an adamant and unreasonable stand that they have no right for negotiation but should accept whatever is offered by the management. Their bureaucratic mindset has not so far changed. No trade union can accept such an irrational stand. BSNL Employees Union, the only recognized and representative union in BSNL and other six Unions allied with it, submitted memorandum with fully justified demands for early revision. However, the management delayed negotiation on the plea that approval from DoT, the administrative ministry, is required to start negotiation.

Negative stand of management

On the threat of strike notice for 11-12 December 2008, negotiation started. But since there was not even a single Director of the Board in the Committee no decision could be taken. The union was compelled to give another strike notice for another strike on 19-20 May 2009.The strike was deferred after the management agreed to pay six months pay advance and House Rent Allowance at higher rates as recommended the II Pay Revision Committee. It was assured by management that the wage revision will be settled expeditiously.

Instead of agreeing to the justified demands of the employees i.e. fitment benefit as per top executives for pay + DP + DA (78.2%) ordered by government and Department of Public Enterprises, management proposed lower fixation benefit with 10 years periodicity. The main demand of the union was that the periodicity of wage revision should be 5 years. On the background of the strike notice issued for 7th May 2008, the Prime Minister has called the Central Trade unions and had assured that the periodicity can be from 10 years upto 5 years. The Department of Public Enterprises (DPE) has issued orders to that effect. Despite all these, the management is refusing to agree to 5 year periodicity. In order to delay further, the matter was referred to DoT. The negative and adamant attitude of management resulted in the workers going on strike on 19-20 August 2009.

Magnificent Strike

The Strike was a complete success with maximum workers participating. NFTE (AITUC) and FNTO (INTUC) opposed the strike, stating that they are prepared to accept whatever is offered by the management. They also opposed that the issues of contract/casual workers and BSNL pensioners are included in the demands. According to them, unions should raise only the demand of the regular workers.

Further, they surrendered to the advice of the management to collect declarations from the workers stating that whatever has been offered by management is acceptable. But when NFTE and FNTO leaders went to get signatures on these forms, the workers completely rejected. They could not collect declarations even from one percent of workers. BSNLEU had earlier approached all these unions to join the strike but they had declined. Instead, they propagated against the strike. Despite the combined conspiracy of the management and these scab unions, the workers participation was full.

The strike spread like wildfire all over India. All the offices and exchanges stood closed in the six North Eastern States (Tripura, Meghalaya, Mizoram, Nagaland, Arunachal Pradesh, Manipur), Assam, West Bengal, Kolkata Telephones and Kerala and no employee attended duty. Strike was more than 90% in Gujarat, Rajasthan, Himachal Pradesh, Uttarakhand, Madhya Pradesh, Orissa etc. All over India more than 80% workers participated in the strike.

The entire customer service centres, fault repairs, marketing etc. were at a stop. Only very few top officers could attend office. Many members of the FNTO and NFTE protested against the anti-strike stand of their leaders and resigned from their unions participating in the strike along with other workers.

The Casual and Contract Workers went on strike as per the call of the BSNL Casual Contract Workers Federation. They appreciated the fact their demands were raised in the strike and the regular employees are on strike for settling their demands. The Pensioners Association also supported. In many places the BSNL retirees participated in demonstration and dharna.

The management brought police force in many centres to remove the striking workers who were sitting in dharna or demonstrating in front of their offices. But the workers stood firm and resisted police action. Lady workers took a prominent role in many places.

Support from Trade Unions

CITU, NFPE, BEFI, AIIEA, Confederation of Central Government Employees and Workers, Executive Associations in BSNL and many other organizations fully supported and extended solidarity to the strike.

The newspapers and media gave good publicity. In fact, the management was unable to reply to the questions of the media. Their press statement that the services were not affected, did not convince anybody.

Historic Strike

The 48 hours strike has once again shown that the workers will rise to the occasion to defend their interests. Despite the conspiracy of management and scab unions, more than 80% participated in the strike on the call of BSNL Employees Union and United Forum. BSNLEU has won the verification with only 53% of polled votes, but it could get 80% support of workers in the strike. This is a great achievement. This has to be taken forward for further strengthening of the joint movement.

BSNL Employees Union has raised the demands on wage revision as decided by CPSTU (Committee of Public Sector Trade Unions) conventions and started the struggle. The workers want that the periodicity which has been increased from 5 to 10 years should be restored to 5 years.

This struggle has enthusiased and inspired the workers so much that they wanted the strike to be converted to indefinite strike till the issues are settled. But the United Forum took the correct decision to wait for some more time for the management to settle the issues, failing which the unions will have no other course left, but to resort to indefinite strike.

BSNL Employees Union and United Forum express their thanks to all the persons, unions, media and the public who have given all support and extended solidarity to the struggle. We want the management and government to understand the feelings of the workers.

The true colors of FNTO exposed

In recent times, especially after joining the United Forum in 2004, FNTO has been asserting that they are not against struggles and their role as strike breakers as done in 1968 and 1974 (Railway & Confederation of Central Government Employees strike) has been changed. Despite these assertions, FNTO leaders opposed the strike of 11th July 2007 in the meeting of Joint Forum and it was only after BSNLEU and Executive Associations took a firm stand on strike that FNTO joined. We appreciated the decision, even if late.

But after leaving the Joint Forum on flimsy grounds, again FNTO has resorted to its original role of Strike Breaker with the support of management. First it stated that whatever is offered by the management be accepted. When BSNLEU and United Forum demanded for fitment as given to top executives on 78.2% pay (Pay + DP + DA), FNTO propagated for acceptance of 30% fitment on 68.8%. The demand of the entire PSU unions including BSNLEU for restoration of 5 year periodicity (as existed in PSUs earlier), was ridiculed by FNTO and propagated that revision in 10 years is better than once 5 years. They questioned why BSNLEU is taking the issue of wage increase of Casual & Contract workers or the pensionary benefit of retired employees.

Signature campaign for management

As usual on line with scab unions, it organized submission of declaration forms to management accepting whatever latter offered. Despite covert and overt support from management and forged signatures, it could not even submit 2% of such forms to management. Even their workers understood the dirty tactics of the leaders and completely rejected and defeated the same.

Strike-Breakers, once again

Once again, strike started, the true colors of FNTO got exposed. They propagated against demands, against strike. Not satisfied with that, its leaders started abusing and slandering the striking workers and its leaders. But it did not have any effect as the workers rejected it with contempt.

Role of Agent Provocateur

Seeing that and almost all the workers went on strike, FNTO became panicky. Many of its local leaders and large number of members also joined the strike. FNTO approached CMD, Director (HRD) etc. and wanted to use police to arrest the striking workers who are organizing demonstration, dharna etc. outside. FNTO leaders pressurized the management to file FIR against the striking workers. The top management also put pressure on the police. This was the method strike breakers used in 1968 and 1974 and got many arrested and jailed. But the times have changed and they could not do much.

Dies-Non

FNTO has demanded the management to cut the salary of the workers who went on strike. Same as done in earlier strikes. Of course, we need not mention, because it is the role of scab unions.

Indefinite strike

There was demand for indefinite strike from the field units, but considering all aspects, the United Forum unanimously decided to end the strike after 48 hours as scheduled and decided earlier.

Benefit for all

Despite all these, the strike has been a big success. Now discussions will start and United Forum and BSNLEU will try to get the maximum benefit to workers, not only for those went on strike but to all employees.

The continued membership verifications have shown the fate of those who oppose workers’ interest. FNTO, of course, can have introspection.

With deep sorrow we inform that Com. Jagadendra Bhattacharjee, Veteran P&T union leader and former Circle Secretary of E-III union of undivided Assam Circle from 1972-1983 breathed his last today morning. He was the convener of the Joint Committee of Trade Unions of Assam and held many other posts in union. He was in jail for 18 months during Emergency. He was unmarried and dedicated his entire life to the cause of workers.

CHQ conveys its condolences to the bereaved family and comrades.

The United Forum met and congratulated the workers for the excellent 48 hours strike. The strike was participated by more than 70% workers, giving shock waves to management.

The glorious strike will end at 24:00 hours, today, 20th August 2009. Employees should join duty tomorrow, 21st August 2009. Victory Rally should be organized at convenient time tomorrow by holding demonstrations etc.

Red Salute to Workers and Leaders who participated and made this strike historic. We congratulate the Contract & Casual Workers who also participated in the strike. We also thank all who have supported us.
